The offer makes no sense. Some people vote in September. Many people vote in October. Ballots are already printed by then. Withdrawal will have limited value at that stage.
With sufficient ballot status, Kennedy is definitely in a position to deal. But, is this the best deal to offer?
In a game of staying relevant and focused on the issue that matters “electability” this is a brilliant publicity stunt redux.

What sufficient ballot access? And what is he actually offering? He’s offering to withdraw too late to be removed from any ballots, and after a lot of ballots will have been cast.

Hmmmmmm, Congress changed the law two years ago to completely remove any power from the hands of the vice-president while presiding over the electoral vote count in congress.
Sorry, I forgot that. In that case, the best question I can ask is theoretical – what if this court ruling cane down 4 years ago, would Mike Pence have then felt free of any concern of personal consequences if he had not certified Biden states? Of course he may have still certified them for other reasons, but suppose that was the only thing stopping him.
