On July 11, he RFK, Jr./Shanahan Campaign handed in its petition signatures to the Colorado Secretary of State.

Presuming that the Campaign has enough valid signatures (I don’t know how many signatures were turned in, but I would be shocked if they didn’t have enough valid signatures of Colorado registered voters), this would mean that Kennedy/Shanahan would be on the ballot as an Independent ticket, and not on the Libertarian Party line in that state, because Colorado does not allow candidate fusion.
So state law prohibiting “fusion” candidates acts to moot the Colorado Libertarian Party’s disaffiliation from the national LP, UNLESS the LPCO formally endorses Kennedy (or Trump or Biden or anyone else) over Oliver. They can endorse “None of the Above Candidates is Acceptable” or advocate boycotting the election without violating nation LP bylaws.
They already did.
Where is there a state law in Colorado prohibiting fusion voting?
Yes, like most states.
So is there still any way, e.g. through a lawsuit, by which Kennedy can switch from independent to Libertarian on the Colorado ballot, now that he has qualified as an independent and the petition deadline has also passed?
Because if not, then Caryn Ann Harlos really screwed the LPCO without doing any damage to Kennedy’s campaign.
It was already a very one-sided deal that favored the LPCO far more than Kennedy. He was doing them a favor by giving them national exposure in return for making himself look slightly less unpalatable to Libertarians, one or two of whom might even vote for him over Oliver and Trump…
CAH meant to harm the Kennedy but exclusively damaged the LPCO, which still isn’t going to certify Oliver even if they now can’t certify Kennedy either. Or to use her own charming vernacular, Harlos whored herself out for nothing!
They will sue each other, and have no candidates for p/vp on the ballot, as it should be.
