Ohio Independent Legislative Candidate Files Federal Ballot Access Lawsuit

On July 11, independent legislative candidate Justin Tjaden filed a federal lawsuit against the Ohio ballot access law for independent candidates for district office. Tjaden v Geauga County Board of Elections, n.d., 1:24cv-1176. The plaintiff had tried to get on the ballot this year, but was told he didn’t have enough valid signatures. He originally sued in state court. He is an attorney and he is using the lawsuit to attack the idea that independent candidates need far more signatures than primary candidates running for the same office. See this story.

The case is assigned to U.S. District Court Judge Solomon Oliver, a Clinton appointee.

  1. The only way to punch through any ballot access restrictions is to go pro se to argue free association and equal treatment arguments.

    There’s little to no money on these lawsuits to get big shot law firms.

    Same is true in zoning or property rights cases.

    And in many cases, attorneys are demanded to conform in their industry so they won’t even take the case if you pay them to avoid uncomfortable anti-government arguments.

  4. JD Vance is an excellent pick. Only Donald Trump Jr would have been better.

  5. Vance isn’t the worst pick, but he certainly isn’t the best either. Unreliable on the Second Amendment. Unreliable on Covid. Unreliable on abortion. And too much of a pussy to even debate Kreepy Kackling Kamala, despite knowing he should be easily able to win.

    As for RINO Donny the Lesser, either socialism is sexually transmissible and he got from Gavin Newsom’s sloppy-seconds, or he inherited it from his parents. And all evidence points to the latter.

    But you know who would’ve made a good GOP ticket? Doctors Ben Carson and Rand Paul. In either configuration. Now that I would vote for.

  6. Who said Vance won’t debate Harris? Last I heard they’re negotiating details. Of course, those might be in flux when there’s some consideration that she might jump to the top of the ticket and choose a different VP such as Secretary Buttigieg or Hunter Biden, in which case that’s who Vance will debate.
