U.S. District Court Upholds Mississippi’s Law Allowing Five Days After the Election for Mail Ballots to Arrive

On July 28, U.S. District Court Judge Louis Guirola, a Bush Jr. appointee, upheld Mississippi’s law that allows five days for voted absentee ballots to arrive in the elections office.  Republican National Committee v Wetzel, s.d., 1:24cv-37.  The Libertarian Party of Mississippi had filed a very similar lawsuit, 1:24cv-37, and the two cases had been combined.

The plaintiffs argued that federal law sets the election day and that an “election” is not held until the ballots arrive in the elections office.  The judge disagreed.  Here is the opinion.

  1. Nonsense. It depends entirely on what is meant by absentee ballots. UOCAVA ballots that are postmarked prior to election day, are completely valid.

And despite any disagreements we may have, I want you to know that I greatly appreciate your dedication to Ballot Access News, the sheer amount of time and effort you have so generously invested in it, and your tremendous patience with commenters, including myself, and our (ab)use of free speech. I am deeply grateful to you.

    Unfortunately, my positions regarding for example the war in Donbass, the January 6th protests, the Covid pandemic, the George Floyd riots, etc. have made me a paradoxically sought-after persona non grata.
    As such, I’m not sure what would be a safe way for us to talk. Of course, I am always more than happy to exchange ideas publicly here on BAN, or on IPR; and if either has integrated any of WordPress’s plug-ins for direct messaging, that might be an option to speak more privately (though WordPress’s security is also notoriously leaky as a sieve).
