Shiva Ayyadurai Sues Nebraska Over Ballot Access

On September 30, independent presidential candidate Shiva Ayyadurai filed a federal lawsuit against the Nebraska Secretary of State. Even though his petition had enough valid signatures, the Secretary of State kept him off because he was born in India. Lauters v Evnen, 4:24cv-03175. The case is assigned to U.S. District Court Judge John Gerrard, an Obama appointee. Here is the Complaint.

No presidential candidate in history has filed so many lawsuits over constitutional qualifications and ballot access. In the distant past, states always put such candidates on the ballot, as happened in 1892 when the Prohibition Party nominated a 33-year old for vice-president. No state kept him off the ballot on the grounds that he didn’t meet the qualifications. That is because in 1892, people undrestood that the true candidates were the candidates for elector. Back then the voters of every state voted for individual candidates for elector.

In 1972, when the Socialist Workers Party nominated Linda Jenness, who was 33 years old, she waged a vigorous legal challenge to the Ohio decision to exclude her. But she lost that case, and did not sue any other states over that issue.

Peta Lindsay, the 2012 nominee of the Party for Socialism and Liberation, also an underage candidate, only filed one lawsuit, in California. When that lost, she did not file any other lawsuits.

But Ayyadurai has now sued New Jersey, Utah, Wisconsin, Tennessee, and Nebraska. His lawsuits always point out that the true candidates are his candidates for presidential elector, and they meet all the qualifications.

    I noticed:
    -Each of the minor parties had a lot of downballot candidates
    -Each party gets a column, and you may vote straight ticket, or pick and choose
    -The presidential and underage vice presidential candidates are not even listed, the electors are shown instead

    Also shown in the picture is the People’s Party ticket. Their presidential candidate won 22 electoral votes, even though he lost his home state.

    Shiva Ayyadurai is a hardworking and determined Indian immigrant (unlike say, for example, Shyamala Gopalan “PhD”). He invented the first iteration of E-mail, for goodness sake – yes, really. Whereas Linda Jenness and Peta Lindsay are communists who don’t even know the meaning of the word “work”.

I was being sarcastic (hence the exaggerated tone of my comment 🙂 ) about Shiva’s claim that he achieved everything in life through elbow grease, when in fact he was incredibly privileged through affirmative action and got showered with unearned degrees and grants. His claim to have invented the first iteration of E-mail is, I think, a result of his getting used to being credited for the work of his colleagues and students at MIT. But then he tried to kick away the ladder that got him where he is, and suddenly he went from being a diversity poster child, to being demonized and canceled for being anti-DEI.

  49. Screaming wacko: why would you drain the great lakes? You have the Pacific, gulf of Mexico and Rio Grande. There’s also mountains and a wall that needs to get finished. If a moat is added the great lakes would not come into play. It would not have to be fresh water, so the ocean and gulf would do fine.

  53. AZ – I once heard that the most logical place near the east coast of the US. to store radioactive waste were the salt dome caverns near Detroit. Are these what you refer to? I heard it suggested partially as an argument against making the sacred lands of Yucca Mtn in Nevada a national sacrifice zone and overlooking not only the significance of the lands to Native Americans, but the significance of the fault zone that ran through the land!
    An equally big fight is over the two commercial waste facilities on either side of the NM-TX border, some 30 mi away from each other, I believe. One of them is being developed by HOLTEC with the idea of transporting waste from around the country via rail to this “temporary storage facility,” temporary being estimated at about 200 years. I believe it may have been halted by the NM governor however.
