Jill Stein Sues Ohio in Order to Permit Her Votes to be Counted

On October 9, Jill Stein filed a federal lawsuit in Ohio in order to see that votes for her are counted. She is on the ballot, but earlier this month, the Secretary of State said he would not allow her votes to be counted because of a mix-up over vice-presidential substitution. Here is the Complaint, which explains what happened. Stein v LaRose, s.d., 2:24cv-04042. The case is assigned to U.S. District Court Judge Sarah D. Morrison, a Trump appointee and the chief judge of the southern district.

  1. Word has already gone out that votes for her won’t be counted. Even if she wins this suit, at best she will regain only a fraction of the votes she would have gotten otherwise.

  2. I got my absentee ballot today. As expected, it included the notice that votes for Jill Stein and Anita Rios will not be counted. I will proceed as planned, casting my protest write-in vote. Maya Butt-Hertz for President, and Ivy Ben Scrood for Vice President. If Jill Stein wanted my vote, then this lawsuit should have been filed much sooner, before absentee ballots actually started to be mailed to voters.

    Apparently Stein was getting ratioed about that on her Reddit Q&A:

    “We are on the ballot in Ohio! Rest assured that as long as you choose the option that says ‘Stein’, you’ll be voting for us! There are some technicalities being resolved regarding the VP name listed on the ballot, but we fully expect those issues to be resolved in time for the election.”

  5. The Stein campaign website’s ballot access map hasn’t been updated since 9/20/2024, which is before all of these legal problems started in Ohio. To me, that seems a tad disingenuous. There should at least be an asterisk by Ohio, and/or a note with some more details. But nope, the Stein campaign is acting like everything is still just hunky-dory.

    Even if this issue does get resolved, I could still envision some ridiculous compromise where votes for the Stein/Rios ticket that actually appears on the ballot will not count, nor will write-in votes for Stein/Ware, but if you write-in Jill Stein and Anita Rios, then those votes would count. Of course, in that unlikely scenario, it would still require the voter to disobey the specific instructions on the ballot, that say not to write-in the name of any candidate that already appears on the ballot for that race.

    Either way, it is already too late to salvage my vote. I don’t like the uncertainty over whether my vote for Jill Stein would have counted, or over which method I would have had to use (fill-in the bubble, or write-in) in order to get my vote to count. And, if write-in, then which ticket? I don’t want to wait until election day to see if this gets resolved, before casting my vote. So, I have already mailed-in my absentee ballot with my protest vote.

  6. Okay, Jill Stein’s website team may not have the resources to update their website now. How about the Richland County Board of Elections website? To this day, when I click on the Candidate List button, and filter the list for Federal candidates, it still shows the ticket of Jill Stein and Anita Rios as “Valid.” This is despite having the required notice (albeit in relatively small print) on their Home page about Anita Rios’s “withdrawal” stating that votes for that ticket will not count. This same Candidate List also excludes all Libertarian candidates for President, Vice President, and US Senate, despite those candidates actually appearing on the ballot, with no challenges against their ballot eligibility.

    Do states have the right to toss votes for certain presidential electors?
    Obviously the US Constitution does not restrict them.
    The Constitution does not even mandate the popular vote for president.
    But I think it gives Congress the right to do so.
    Did Congress ever pass such a law?
