New Jersey Democratic State Committee Declines to File Response in U.S. Supreme Court in Shiva Ayyadurai Ballot Access Case

On October 8, the New Jersey Democratic State Committee informed the U.S. Supreme Court that it does not intend to file a response in Ayyadurai v New Jersey Democratic State Committee, 24-342. This is the case in which independent presidential candidate Siva Ayyadurai was challenged off the New Jersey ballot by the Democratic Party. He had enough valid signatures but he was challenged for having been born in India.

In the past New Jersey had printed the names of five presidential or vice-presidential candidates on the November ballot, even though they did not meet the constitutional qualifications.

  1. So, the NJ Democratic Party doesn’t contest the fact that, alto Shiva is not qualified to be President, his name may remain on the ballot? Do I understand their actions correctly?
