Four States Sue to Force Census to Ask About Immigration Status

On January 17, four states sued the federal government to force the Census Bureau to ask about the immigration status of each person. The State of Louisiana v U.S. Department of Commerce, w.d. Louisiana, 6:25cv-76. The other states in the lawsuit are West Virginia, Ohio, and Kansas. Here is the Complaint.

The suit claims that if the population figures for each state reflected the number of illegal aliens, and those persons were not included in the formula for determining the number of U.S. House seats, that states like Louisiana and West Virginia would gain another member of the U.S. House, and of course certain other states, like California and Texas, would lose some seats.

The reason the Census Bureau doesn’t ask about immigration status is that if the question were asked, many people would refuse to cooperate with the Census.

The Fourteenth Amendment, Section Two, covers apportionment of U.S. House seats. It says, “Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed.”

The case has not yet been assigned to any particular judge.

  1. So what if people who shouldn’t be here don’t cooperate with the census? They need to go home and cooperate with the census in their own countries.

  2. The wording originally excluded Indians not taxed, which should make clear that foreigners should not count. Would you count invading armies, tourists, or temporary residents?

  3. If a citizen of one state is physically in another state at the time of the census, which state does he count toward? Logically it should be the state of which he is a citizen. The same principle should apply internationally.

  5. In law, when a phrase excludes one particular type of category, it can be presumed that other categories not mentioned are therefore not excluded.

    People who are on a trip to another state are still expected by the Census to list themselves according to where they live, not where they are at the moment.

    Great Britain has a different census policy. If one is physically present in Great Britain on census day, even if one is just a foreign tourist, that person is included in the census. I know that because it just happened that I was visiting a friend in England on census day and the instructions for the census form made it clear that I should be listed.

    So why wouldn’t foreign visitors such as illegal invaders be counted as residents of their own countries rather than of a country where they have no legal right to be at all?

  10. If someone has been sleeping in a particular residence for as long as 50 years, and never ever leaving the state of residence, one is “living there.” Robert F. Kennedy, Jr., was kicked off the New York ballot because he listed a residence address at which he apparently never, or almost never, slept there. Where one habitually sleeps is the place where he or she is “living.”

    There is no basis for anyone to say anything about my willingness to shelter anyone. Whoever makes these comments is ignorant.

  13. I agree with this lawsuit. Only American citizens should be counted for the purpose of allocating US House districts. The government is supposed to represent citizens, not foreign nationals.

    The reason that Native American Indians were not counted at one time is because they were not considered to be American citizens until an act of the US Congress passed in 1924 which granted them American citizenship.

    Counting non-citizens, particularly illegal aliens, is a way for some states to cheat and gain an extra level of representation in the US House which they do not deserve.

    I think that the founders of this country as well as Americans in the 1800’s did not envision a day when a day when there would be millions of illegal aliens in the country and when corrupt people in government and influencing government would be enticing them to come here using taxpayer funded programs az a lure, and by having government officials tasked with regulating border crossings intentionally fall down on the job.

    Also, keep in mind that travel was far more difficult in the 1700’s and 1800’s than it is today. Back then even walking here was more difficult than now for those who were in a place where that was an option. Most people in the world back then had no means to get here.

    Now if a state wants to cheat all they have to do is bus or fly or otherwise lure a bunch of people in who are not citizens and then they can get more US House Reps.
