Tennessee bills to make it a felony for a local government official to cast a vote in favor of creating a sanctuary passed the legislature on January 30. The identical bills are SB 6002 and HB 6001.

  2. Is voting to violate federal law an official act? If sanctuary laws harbor federal fugitives, don’t they violate federal law?

    If this new bill is signed into law, then if a Memphis city council member votes in favor of some local ordinance that creates a sanctuary, they will get convicted as a felon and removed from office. And then after they serve their sentence, they can’t become a city council member again unless a court reinstates that privelege. If they tried to run for office anyway, the government probably would refuse to print their name on the ballot. It’s similar to the Insurrection Clause of the 14th Amendment.

    Marijuana’s still illegal federally, but there are stores now in my town that sell it. Also, some churches used to be sanctuaries, right?

    I just think it’s so weird to make voting for a bill a felony, no matter how bad or unconstitutional it is. The executive branch is supposed to say “no way, I’m not doing that, that’s a federal crime” and then it goes to court.

  5. This ordinance is probably unconstitutional but sanctuary cities, states and counties do not just protect the rights of the undocumented. Many county sheriffs refuse to enforce federal gun laws with which they disagree. Sanctuary can cut many ways.
