On February 18, the New Hampshire House Election Law Committee defeated HB 172. It would have prohibited independent voters from voting in partisan primaries.

  2. NH House committees don’t “defeat” bills. They only issue a recommendation that the bill is Ought To Pass, or is Inexpedient To Legislate.

    Every bill in NH gets a public hearing, and is voted on by the full House.

    The constitutional interpretation that the President must spend every penny allocated by congress, and furthermore has no discretion at all within that budget, is far from universally shared.

    “No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.”

    That does not say every penny has to be spent, and the account of expenditures has been rather sloppy for quite some time.

    Any court decision which claims that the President is obligated to spend every penny allocated by congress can be overturned. It seems to me that a plain text reading leaves plenty of room to exercise discretion and leave money in the treasury.

    All court precedents can be overturned, even Marbury v Madison, so please always check back against what the constitution actually says and not what it’s been held to say over the years.

    Speaking of which , I still don’t see any section which authorizes bureaucratic agencies issuing regulations that have the force of law.

    With a government that’s grown to literally millions of employees spending trillions of today’s dollars per year – more than the total number of people and their combined wealth in the united States when the constitution was approved – it’s no secret or mystery that there’s no real opportunity for a few hundred members of congress to oversee or analyze every detail of how the money is actually used. In practice the money is allocated by the bureaucracy itself and congress gets assurances that it’s all necessary and indeed inadequate and votes on that basis, so government keeps growing further out of control every year.

    Trump is a long way from being an absolute monarch or dictator. He’s made a very bare start to the regular statement of account and expenditures. And that’s what the collective bureaucratic dictatorship and their sycophants are protesting here and calling tyranny when it is they who are the tyrants.

    They don’t want any comprehensive audit of how they actually spend all that money, much less anything short of Soviet style job security or control over the country. Byzantium, Kafka, and Orwell are inadequate to the task of analogizing what they have turned our constitutional Republic into, and getting it unwound will in no way be easy, painless, or unopposed at every step.

    But, it must be done – at some point either the host must control the parasitic infection, or it kills the host.

  16. The president IS taking care that the laws are faithfully executed. Indeed, he’s the first president in quite some time doing that. Spending appropriations just authorise the President to spend certain amounts for certain categories – they don’t obligate or compel him to.
