Arkansas Lawsuit Filed to Overturn Many Restrictions on the Initiative Process

On April 21, the Arkansas League of Women Voters filed a federal lawsuit to overturn many new restrictions on the initiative process, as well as some old restrictions. League of Women Voters of Arkansas v Jester, w.d., 5:25cv-5087.

The lawsuit attacks the in-state residency requirement for initiative petitioners, the new law that tells petitioners that they can’t accept a signature until the petitioner has seen the signer’s photo ID; the new law that says the names and addresses of paid circulators must be submitted before they can work and this information will be a public record; the new law that requires circulators to read the entire description of the initiative to anyone who is approached; the new law that requires circulators to tell everyone they approach that “petition fraud” is a crime; and many other restrictions.

The case is assigned to U.S. District Court Judge Timothy L. Brooks, an Obama appointee.

    Washington — Two major law firms are expected to ask separate judges on Wednesday to permanently block President Donald Trump’s executive orders that were designed to punish them and hurt their business operations.

    The firms — Perkins Coie and WilmerHale — have said the orders imposed in March are unconstitutional assaults on the legal profession that threaten their relationships with clients and retaliate against them based either on their past legal representations or their association with particular attorneys who Trump perceives as his adversaries.

    New York — A federal judge on Thursday will hear arguments in three cases from national Democrats and voting rights groups that are challenging President Donald Trump’s recent executive order on elections, which, among other changes, would require proof of citizenship to register to vote in federal elections.
    The Democratic National Committee, the League of United Latin American Citizens, the League of Women Voters Education Fund and others are seeking to block Trump’s sweeping overhaul of federal election processes, alleging that the changes he wants are unconstitutional.

  5. I hope they are also suing over the prohibition on pay by the signature. Pay by the hour is not a good system for paying petition circulators.
