Nineteen States Sue to Invalidate President Trump’s Executive Order to Modify Federal Voter Registration Form

On March 25, President Donald Trump issued an Executive Order that the federal voter registration form should be altered to provide that applicants must attach proof of citizenship. On April 3, nineteen states filed a federal lawsuit to overturn the Executive Order, on the grounds that the President has no authority to alter the form. State of California v Trump, U.S. District Court of Massachusetts, 1:25cv-10810. The case is assigned to U.S. District Court Judge Denise Casper, an Obama appointee. Here is the Complaint.

  1. This is not an instance of judge shopping. Massachusetts is all one U.S. District Court district. In fact it is the most populous state that isn’t divided into districts. Massachusetts has 20 U.S. District Court judges. So when the plaintiffs filed their lawsuit, they had no idea which judge would get the case.

    Judge-shopping relates to states that are divided into several districts and divisions, so that in such places the plaintiffs can know in advance which judge they will get. Texas is the prime example.

    If anyone thinks the president has the power to dictate the format of a voter registration form, where in the US Constitution does one find such power?

  5. Massachusetts is hardly a neutral jurisdiction. Some of us still remember they were the only state to support the disgraceful communist McGovern in 1972. Not that there was anything with not voting for Nixon – I voted for Wallace (1968 general and 1972 primary) and Schmitz (1972 general) myself, although I’m most proud of my vote for Lester Maddox in 1976, after voting for Reagan in the primary.

    But, why didn’t these evil sinister leftist scumbags file their ridiculous lawsuit in Texas or Florida, or for that matter Georgia, Alabama, Mississippi, Louisiana, or South Carolina? Why not even Oklahoma, Tennessee, Kentucky, North Carolina or Arkansas? I think we all know the answer.

    This is one of the many reasons it’s such a shame that the damned yankees won the war of northern aggression. If the South would have won, we’d have had it made!

    The day is coming, rest assured, when all these leftist, communist judges will be impeached, removed, tried, found guilty, and executed for treason. That day can’t come soon enough!

  7. Lincoln was the tyrant. His execution for treason, which was well deserved, was unfortunately extrajudicial. The Southern States had every right to secede, and were right to do so.

  8. Indeed, if at first you don’t secede, try and try again. Secession backed by nuclear, biological and chemical weapons (mutual assured destruction) seems more promising.

    As for the phase of the war against communist aggression known as WWII, where were the executions of tyrants Stalin, Churchill, Roosevelt, and their henchmen?

Richard Winger, if the federal government can issue a voter registration form, how can it be created and distributed except as facilitated by the executive branch, of which the President is in charge? Additionally, “shall take Care that the Laws be faithfully executed.” The federal voter form asks if those who fill it out are citizens, presumably because whatever law created this form says they must be. It’s entirely reasonable for the President to ask them to provide proof, since people are not always honest and since it impacts the value of every citizen’s vote when those who aren’t supposed to vote do so anyway.

    For the court to have issued a ruling, the attorneys representing the executive branch must have made an argument. Have you posted that argument or looked at it?
