On April 24, U.S. District Court Judge Colleen Kollar-Katelly, a Clinton appointee, issued a 120-page order in League of United Latin American Citizens v Executive Office of the President, 1:25cv-946. It says that the President does not have the power to alter the federal voter registration form. In March President Trump had issued an executive order that applicants who use the form must attach documents that prove U.S. citizenship.

  2. Fred, can you find anything in the Constitution that gives the president the power to alter the federal voter registration form? Article II contains all the powers of the president.

Richard Winger, if the federal government can issue a voter registration form, how can it be created and distributed except as facilitated by the executive branch, of which the President is in charge? Additionally, “shall take Care that the Laws be faithfully executed.” The federal voter form asks if those who fill it out are citizens, presumably because whatever law created this form says they must be. It’s entirely reasonable for the President to ask them to provide proof, since people are not always honest and since it impacts the value of every citizen’s vote when those who aren’t supposed to vote do so anyway.

    For the court to have issued a ruling, the attorneys representing the executive branch must have made an argument. Have you posted that argument or looked at it?

  6. Helpful guy, the president does not equal the federal government. The US House has already passed a bill to amend the voter registration form. That is the way to do it. A better solution would be to do what the British government does. The British government, before each national election, sends an employee to each household, and he interviews the residents and prepares the list of registered voters, including evidence of citizenship.

  8. I’m still waiting for any commenter to tell me where in the US Constitution the president has the authority to order a change in the federal voter registration form. Article II is the place to look.

  9. I never said or implied that the President is the entire federal government. The President is the head of the executive branch. The executive branch executes the laws passed by congress, including the particulars of any form and any additional action needed to ensure that people who fill out those forms don’t lie, whether that be attached proof of citizenship or whatever else. The President is charged with ensuring the laws be faithfully executed, so that would include this executive order. You have not addressed these answers or answered whether you’ve looked at the arguments made to defend the executive order in court.

    Is it normal for congress to legislate the details of every federal application form and what documents are needed to ensure that applications aren’t fraudulent? Passport applications? Welfare applications, grant applications, federal contract applications, etc? Is the executive branch empowered to execute the details of such laws, with the President being the head of the executive branch?

    That would be a waste of tax money and violation of privacy, as well as hard to arrange given the different and often unpredictable schedules people have to keep.

    An actually better solution would be for all voters to register to vote in person at the county courthouse and provide proof of citizenship at that time. Do away with motor voter and mail in voter forms.

  13. People should also vote in person by on the record voice vote or standing count. No absentee votes.

  14. An even better solution is standing count. Non citizens and illegals would automatically be deported. Citizens committing fraud would receive 20 years in prison.
