California Minor Parties File Brief in Lawsuit Against Top-Two

On June 26, the Peace & Freedom, Green, and Libertarian Parties filed this brief in U.S. District Court in Peace & Freedom Party v Weber, n.d., 3:24cv-8308. This is the lawsuit against the California top-two system. The brief is 40 pages.

    In recent years, Michigan voters have approved ballot proposals ushering in major changes to elections in the state, from giving every voter the right to cast an absentee ballot to early voting. Will they approve ranked choice voting next?
    A group called Rank MI Vote hopes voters will adopt a ballot proposal to bring the voting method to Michigan elections for major federal and statewide offices. The group’s proposed amendment to the Michigan Constitution could appear on the November 2026 ballot. To put the issue up for a vote, organizers need to collect at least 446,198 signatures from Michigan voters.

  3. A March primary is not intrinsic to Top 2. Proposition 14 itself was approved at a June primary in 2010, and the first four Top 2 primaries were in March. If there is a constitutional conflict between a March primary and Top 2 primary, it is the primary date (a creation of statute) that must give way to the Top 2 primary a provision of the California Constitution.

  4. Time to expel California from USA.

  5. The U.S. will never expel California from the Union. It sends more money to the U.S. government than it gets back. It supports states like Texas which sends less money to the U.S. than it gets back. In fact, many states get back more money from the U.S. than they pay into it. If California became a nation, it would have the fourth largest economy in the world. So, be dumb and expel California.

  6. It would be very smart to expel California, your static (as opposed to dynamic) erroneous economic analysis notwithstanding. Getting rid of California will unleash the economic energies of the USA by getting rid of its deleterious effects on our political system. Freed of the shackles politicians impose on the economy thanks to stupid California voters, we will thrive, and yes, it will happen.
