Marco Rubio, Current Secretary of State, Argued in His Ballot Access Case in 2016 that All Persons Born in the U.S., Regardless of The Status of Their Parents, are Citizens

In 2016, Marco Rubio was a candidate for the Republican presidential nomination. His ballot status in the Arkansas Republican presidential primary was challenged by another candidate, David Librace, on the grounds that Rubio’s parents were never citizens of the United States, and therefore Rubio was not a “natural born citizen.” The case was Librace v Martin, e.d., 4:16cv-57.

The decision said that Librace did not have standing, and did not discuss the bigger issues in the case.

Rubio’s attorney, Jason Torchinsky, filed a brief in the case that argues that all persons born in the U.S., except for the children of foreign diplomats and the children of an invading army, are automatically citizens. This stance contradicts President Trump’s position on the matter. Currently Marco Rubio is the Secretary of State.

  7. Birthright citizenship for illegals could easily mean China or India could easily conquer the US by sending say 50 million pregnant illegals in per year. It’s a drop in the bucket to their population. A full scale military blitzkrieg might be quicker, but would be defeated. Chinese military strategy takes a more long term view.

  10. Members of olde American Indian tribes were NOT USA Citizens — even with them being born in USA – ie *internal* foreign regimes.

    It took 1924 and 1940 USA laws for them [few survivors of the many Indian Wars / genocides 1607-1890] to become naturalized USA Citizens.

  11. Marco Rubio was correct to argue that position, until 30 days after Trump issued the executive order. Now that Trump has issued the executive order, he should be arguing in favor of the executive order (for those born after it takes effect).

    The courts are still deciding if Trump’s order is actually legal.

  12. No, he was wrong then and the position he argued remains wrong just as it always was. Plenty of people explained why above with links to much more extensive proof. So far I’m not seeing any substantive counterarguments to any of their points here. Anyone reading think they have some? Even if you have to play devil’s advocate..
