North Carolina Minor Party Activists Delay Implementation of New Regulations that Would Hamper Petitioning

The North Carolina State Board of Elections has promulgated some regulations that would make it more difficult for parties to petition for ballot access. They include a rule saying the circulator must orally tell everyone he or she approaches what the goals of the party are, and a rule forcing all circulators to be publicly identified.

Under North Carolina law, if at least ten adult residents object to new election regulations, the regulations can’t take effect until they are examined by the state legislature. Duruing the last week in August, thirteen qualified individuals submitted objection letters. Most of the objectors are from the Constitution Party, but a member of the Socialist Party, a Liberetarian, and several Greens, also objected.

Even if the new regulations are finally implemented, the pending Cornel West ballot access lawsuit will amend the Complaint so as to challenge the new regulations.

  11. Some people already know what a minir party supports before they sign. Some people do not care that much and just want another choice on the ballot. If somebody asks me I either give them a brief synopsis of what a party stands for or I show them a flier about the party.

    This legislation is unnecessary and would greatly slow down petition signature gathering. It is already difficult to get on the ballot, this would make it much harder.

  12. Andy, Thank you for your perspective from actual petition gathering work. I agree with you. This is just another obstruction to alternative choices on the ballot in North Carolina.

  13. Baloney. Many people would not sign if told the truth. The intent of party recognition petition requirements is to demonstrate which parties have enough popular support to give them a place on the ballot as a recognized party – not to make life easier for petition contractors (or for that matter party supporters) by bamboozling unsuspecting passers by into helping organize parties they would not ever support by not mentioning their stances.

    If you think “it’s already difficult to get on the ballot” it’s because your parties don’t have policies inline with many voters. I helped the American Party get on the ballot in several state’s in the late 1960s and early 1970s and it was not hard to get signed because many folks agreed with us, in fact most folks in many areas where we gathered signatures, and Wallace-LeMay carried several states and came close to carrying several more unlike these minor parties now.

    By the way the purpose of these laws is also not to make it easy to get on the ballot. If it’s hard, the law is having its intended effect of only allowing parties with substantial public support to be organized as recognized and balloted parties.

  19. The Libertarians posted an article on their newsletter on this issue the day before the letters for submitting to the Rules Review Commission expired. And as far as I am have seen the letters of objection, there is at least 1 Libertarian has also submitted a letter to the RRC. The Libertarian Party is also aware of this issue and is also in this fight as well.

  32. Counting of votes would continue to be by election officials. Backed up by video evidence anyone can check for added security against any type of vote counting fraud.

    Voice votes for two competing parties would be the equivalent of a spoiled ballot, except with the possibility of immediate on the spot correction. Standing Count for two competing parties would not be possible since a person can’t stand in two groups at the same time.

    There are possible backups under either voice vote (possible short term solution since we’ve had it before, as recently as 1950 in some states) or my preferred standing count if backups are desired. There are no backups for the growing numbers of illiterates – soon to be a majority, and soon after that an overwhelming majority of the population – under paper or electronic ballots.

    It is ballots which are stone age, not voice vote or standing count.

    Fascism and fascist are way overused words. Not every type of tyranny, dictatorship or oppression is fascist. Fascism was a very specific form of left wing statist collectivism invented in the 20th century which mutated from Marxism and imported from it a fetish for new things, central planning, one size fits all solutions, centralised power, rapid change, overthrowing of traditions, imperialism, and mixing government into all social institutions – all precisely the opposite directions from everything I advocate.

    Not everyone needs to vote.

  35. Voters should be able to print their own write-in only ballots with an encrypted secret ballot receipt generated by their own personal voting machine. Such a system would restore ownership of the ballot and its content to the voter, even if the format of the ballot were prescribed by the state.
