Congressmember Randy Fine (R-Florida) has introduced HR 5817. It says no one may be elected to Congress who is citizen of both the United States and some other nation. Here is the text. It would be unconstitutional under the U.S. Supreme Court decision U.S. Term Limits v Thornton. That decision said neither Congress nor any state may add to the qualifications listed in the U.S. Constitution.
It seems to me that members of Congress who are dual citizens should at the very least recuse themselves when voting on any legislation the involves their other citizenship(s).

AZ: The Department of State website has a description of Dual Citizenship and states the there is no law preventing dual citizenship. I don’t know how to add a link, but I have read the information directly from the State Department. It says that a dual citizen owes allegiance to both countries and must follow the law of both countries.

It is questionable as to whether or not the founders of this country would have accepted dual citizenship as valid. The evidence to me says they would not have.
If so dual citizens should not be able to hold government offices, vote in governmental elections or donate to political campaigns.
Andy: The State Department says that there is no law prohibiting dual citizenship. Whatever you think the Founding Fathers had in mind, they never wrote it down or debated the idea. And neither has any elected official following in their footsteps for the past 249 years. Dual citizens can presently vote, run for office, and donate to campaigns. The only way to change that would be through acts of congress.

I think that having people of divided loyalty in pubic office making decisions on any level concerning the lives of the true citizens would be held to be unconstitutional if the issue were brought before SCOTUS. The very concept was alien to the intent of the founders.
The same is true of people that are part of any organization that is ideologically at war with our constitutions. Communists and muslims are prime examples as well as all illegal aliens – who are are criminals in violation of our laws just by being here.
