On November 18, a 3-judge U.S. District Court enjoined the new Texas U.S. House district boundaries. The vote was 2-1. The decision is by U.S. District Court Judge David Brown, a Trump appointee. It is also signed by U.S. District Court Judge David Guaderrama, an Obama appointee. Fifth Circuit Judge Jerry E. Smith, a Reagan appointee, dissented.

Self-districting would prevent much litigation. Nothing in the U. S. Constitution prevents state legislatures from allowing voters to choose the congressional district in which to vote so long as the one person-one vote rule is not substantially violated in that state. Voters could be allocated to districts by ranked choice when registering or re-registering to vote before a general election. Their effective district would appear on the voter registration card issued to them. The appropriate ballot for each voter could be printed in advance for early and overseas voters as well printed on site at each precinct polling place on election day. Empower voters not incumbent political party politicians.

Let’s apply the Foley plan to Oklahoma congressional districts. If the affinity groups are political parties, Republicans will be entitled to 2.630 districts, Democrats to 1.332 districts, Independents to 0.989 districts, and Libertarians to 0.048 districts.
If there are two whole Republican districts, 76.0% of Republicans will be assigned to that district, and 24.0% to the mixed districts. How will the Republicans assigned to the two types of districts be chosen? Similarly, 75.1% of Democrats will be assigned to the statewide Democrat district, and 24.9% to the mixed districts. I assume the selection will be geographically stratified (e.g., 24.0% of Tulsa County Republicans and 24.0% of Oklahoma County Republicans assigned to the independent district).
The two independent districts would be 31.5% Republican, 16.6% Democratic, 49.5% independent, and 2.4% Libertarian.
If we were doing this for 101 members of the House of Representatives there would be 53 Republican districts, 26 Democrat districts, and 22 mixed districts. Overall, the mixed districts would be 90.8% Independent, 4.4% Libertarian, 4.1% Democrat, and 0.6%. Given that some registered Independents are crypto-Republicans or crypto-Democrats and this varies geographically, who draws the districts?
Filing had already begun for the 2025 districts. Will adjustments be made for petitioning requirements for partisan candidates?
