Riverside County, California, Told to Count 12,563 Late Postal Ballots

On July 9, California Superior Court Judge Mac Fisher ruled that Riverside County should count the 12,563 mail ballots that were not in the hands of county elections officials by 8 p.m. on June 8, 2010.  See this story.  The case is Riverside County Democratic Central Committee v Dunmore, ric-10-012986.

California election law says mail ballots cannot be counted unless the ballots are delivered to elections officials by the end of election day.  In the case of these Riverside County ballots, the voters had postally mailed them in time for normal delivery.  But county elections officials, who routinely stop by certain post offices to collect such ballots, did not visit the post office that actually had the ballots; instead they visited the wrong post office.  UPDATE:  see this more detailed article.  The Judge relied on part on a provision of the California Constitution, added in 2002, that says voters have a right to have their valid votes counted.  It says, “A voter who casts a vote in an election in accordance with the laws of this State shall have that vote counted.”

  1. It’s still not going to alter the outcome in the AIP Gubenatorial race.

  2. Geez, Vaughn… do we HAVE to count votes that are against OUR candidate? It would be unAmerican to do THAT!

  3. The California American Independent Party gubernatorial contest is over, finiti, done. Neither Mark Robinson or Nightmare Nightingale will be on the November partisan ballot. Neither. None. Nada.

  4. The race to watch to see if these late ballots have an effect is the District Attorney contest. Judge Zellerbach appears to have defeated incumbent D.A. Rod Pacheco but it is an outside possibility that the additional votes could change that outcome.

    I voted to defeat Pacheco, so I hope no change, but that is the race to watch.

  5. Don Lake. Since Mr. Mark Seidenberg seems to be in hiding, perhaps you can explain to us all as you write, “Neither Mark Robinson or Nightmare Nightingale will be on the November partisan ballot. Neither, None, Nad.”

    Please explain how you know this will not happen?

    Also, while you are at it, is it true,as some claim,that Mr. Seidenberg is “fronting” for the GOP?

    The election officials did two runs by the post office in Riverside (the county seat) and also a sorting post office in Redlands, which is actually in San Bernadino County, and apparently where ballots have been held in the past. Instead they ended up in Moreno Valley.

    It would be interesting to find out when the ballots had been mailed. On Monday, or the previous week. How many ballots mailed in-county on Monday don’t get delivered on Tuesday, especially in the larger counties in Southern California?

  8. I’m still waiting on Don Lake – and Mark Seidenberg – if he comes out from “hiding,” to tell us why Chelene Nightingale will not be on the General Election ballot there in California?

    Also, is there any truth to the claim made by Dr. Grundmann that Mr. Seidenberg is “fronting” for the GOP? This is important. Not did the election officials run past the post office in Riverside, or will these votes affect the outcome of most state races?

    Come on Don Lake and/or Mark Seidenberg. Give us the lowdown.

  10. Well, they counted them and Nightingale still won over Robinson- you lose Mr. Lake.
