Illinois Supreme Court Stays the Lower Court Opinion in Rahm Emanuel Residency Case

On January 25, the Illinois Supreme Court issued a stay of the State Court of Appeals decision yesterday. This means that during the next few days, while the State Supreme Court is deciding the issue, any ballots that are printed must contain Rahm Emanuel’s name. The election is February 22. Thanks to Rick Hasen. UPDATE: the Court also said it will take the case, will not hold any oral arguments, and will decide the case by reading the briefs already filed in the State Court of Appeals. This means a decision is likely from the State Supreme Court very soon, perhaps even by the end of this week.

  1. How many Chicago troops in the front lines fighting the BARBARIANS in Asia will get ballots from and back to Chicago by the deadline — which obviously will be extended by the IL Supremes ???

    Is EVERY election now a constitutional CRISIS ??? — or only those involving big name party hacks and/or controversial ballot questions ???

  3. Government printing money and printing ballots marked with pre-selected Democrat candidate winners… it’s all for the good of the people. Federal slush money and rural Illinois outstate tax money is the only reason Chicago stays afloat.

  4. The result of the Supreme’s decision isn’t necessarily wrong; it, too, seems rational and fair. It’s reasoning, however, crafts certainty out of thin air. It belittles the problem, seemingly out of pique. The problems with the underlying law in Chicago and the court’s own precedent it simply pixie dusted away, a means to an end that the concurring justices gently chided them about.
