Texas Hearing on 2012 Primary Date

The 3-judge U.S. District Court hearing that concerns the 2012 Texas primary dates, and the dates for candidates to file for the primary, appears to be lasting throughout the day on Tuesday, September 13. See this story, which says that the judges heard from election officials, who asked for a single primary date; and also that the judges heard from Republican Party officials, who want a March presidential primary and a May primary for U.S. House and legislative seats. When the news story was filed, the hearing was not yet over.

  1. How many States are in a state of REBELLION against the U.S.A. Constitution and laws — election law stuff ???

    When will the Prez issue a proclamation to such effect ???

  2. Still going on. Apparently there is agreement to extend filing through December 19th. There is also some confusion whether filings for other offices should have stopped on the 12th, the date set by statute.

    Candidates for the legislature and congress would include a map of the district they are filing for. When the maps are settled, there would be another filing period. Residency issues (for the legislature) would be worked out later.

    I don’t think they realize that the congressional and legislative district boundaries are unlikely to be settled in time for even a May primary, and should just go ahead with the other primaries.

    In 2002, the last election following redistricting, only 90 of 426 legislative and congressional primaries were contested (2 or more candidates). 109 races had zero candidates.
