On October 9, the Tennessee Libertarian Party filed a lawsuit, asking to be placed on the ballot in the December 2013 special legislative election in Memphis. The existing law on how a party gets on the ballot was held unconstitutional earlier this year, and the state is appealing. The new lawsuit is Tomasik v Goins, middle district, 3:13cv-1118.

Mr. Tomasik is running for State Representative, District 91, against a Democrat, with no Republican opponent. Mr. Tomasik is NOT an Independent, he is a registered Libertarian with the national and state Libertarian Parties. It is only right, that the party, which has been in operation since 1972 (41 years),is recognized.

It appears that the Green Party is a part of this current lawsuit and previous battles for ballot access in Tennessee.
