On January 26, Pennsylvania asked the U.S. Supreme Court to stay the decision of the Pennsylvania Supreme Court, involving U.S. House district boundaries. On January 22 the Pennsylvania Supreme Court had invalidated the state’s U.S. House district boundaries for violating the Pennsylvania Constitution. The Pennsylvania State Supreme Court also ordered new districts in time for the 2018 election. The state wants the U.S. Supreme Court to stay that. Little chance of getting stay. Five Justices ruled in Arizona case that Legislature does not have exclusive role in congressional districting. Doubt one of those (Kennedy would be most likely) will be peeled off in this case.

In the Arizona case, the court ruled that “the legislature” included legislation by initiative. The initiative in Arizona prescribed that the manner of election for Representatives be by districts drawn by the redistricting commission.
In other cases, the SCOTUS has ruled that the “legislature” encompasses a veto of redistricting laws passed by the legislature.
In this case, the Pennsylvania Supreme Court is saying that under their general authority to ensure that statutes comply with a novel interpretation of the Pennsylvania Constitution, that they will legislate from the bench, even though they have not yet had an opportunity to write an opinion.
