Washington Secretary of State Agrees to Let Candidate Have “Freedom Socialist” on Primary Ballot

The Freedom Socialist Party has a candidate for U.S. Senator in the August 2018 Washington state top-two primary. Washington state lets all candidates in partisan races choose any partisan label that is 16 characters or fewer and is not obscene. “Freedom Socialist” is 16 characters. Originally the Secretary of State said that a space is considered a character, and therefore the candidate could only have “Prefers FreedomSocialist Party” on the ballot. But on May 23, the Secretary of State changed his mind and will allow “Prefers Freedom Socialist Party.” Thanks to Doug Barnes for this news.

  1. The filing form has 16 boxes. There would be no way to indicate a space without skipping a box.

The number 16 is made up. Under the blanket primary, parties were denoted as (D) or (R) or Dem or Rep. OWL stood for Out With Logic, On With Lunacy. When the Top 2 reform was on the ballot, voters were told that the ballot would look just like under the blanket primary. Part of the reasoning behind the facial challenge was that the ballot for Top 2 would look just the same as for the blanket primary.

In AG Rob McKenna’s and SOS Sam Reed’s defense of the Top 2 before the SCOTUS, they assured the justices that voters would be able to distinguish between nomination and a candidate’s personal political beliefs. They had to devise rules to make this happen for the as-applied challenge. One was to add an explanation to the the ballot and the voter’s pamphlet, another was to add the words “preference” and to add a fuller explanation of the politician’s preference.

In the first election, they let the candidate who wrote that he preferred “SalmonYoga” to run as “Salmon Yoga”. This latest decision is along that line. The Socialist Alternative ran as Socialist Altern. I think they may have been permitted the period.

  2. Actually, Freedom Socialist isn’t a contradiction, but sure, mock the name without spending a second to research the party. I can promise they’d be a better pick than the Democrats or Republicans.

  3. There’s also the rationale that the two letter ‘i’s save two half spaces.
