You may be interested in knowing that if Rosemary Pooler (2nd Circuit US Court of Appeals) is nominated to replace Judge Souter—she is very likely to be rejected because I have very strong evidence of not only impropriety by Pooler, but also of her doctoring the facts and therefore the evidence in cases for her to achieve the results she wants. In particular, I have evidence of a case that related to her daughter Penelope that she ruled on, where Pooler altered the facts and apparently to avenge her daughter.

Obviously SCOTUS has complete jurisdiction over its own court including the eligibility of any incoming associate justices nominated by POTUS and approved with the consent of th US Senate. Also obviously, since the current POTUS is not a “natural born citizen” “NBC” based upon plain language of the US constitution — his father was not a naturalized or birth right US citizen and / or also obviouly the father was not either an african-american of the 1860s era or a grand-fathered revolutionary war era inhabitant
— SCOTUS will / may be finally be forced by its own mandamus or motion to either declare the definition of NBC section of the US Constitution as “dead letter law” or whatever the decide.
The replacement of Souter may finally resolve this entire question once and for all time.
At the same time, an election case long simmering in the USCA 2nd Circuit (Loeber v Spargo 08-4323) is finally comming to a head under a question of a mandated special three judge district court panel, all this testing various NYS election law related sections of the NYS constitution regarding citizenship, legislative districting (including the existence of current NYC itself) and several other seminal election law related issues (i.e. districting populations with legal and illegal aliens, prisoners etc.)
— and might be added to the SCOTUS nomination mix — both prime nominees suggested are female 2nd Circuit Justices Pooler and Sotomayor are the long time overseers of the Loeber v Spargo various appeals during the past five years.

It’s a billion to one shot; but I’d suggest Ralph Nader, if he wasn’t already in his 70s. Great constitutional scholar, mind like a steel trap and not beholden to the powers that be.
1. Obama is a NBC. He won the election. Get over it.
2. I have heard Nader speak twice, and I have also read one or two articles he wrote on election law (an early one on ballot access). He seems to be very competent and ethical on certain legal matters.
Yet, his age, his confirmed bachealor status and the fact that he is not a Democrat or a Republican work against him.
This is such a slam dunk, current person will shortly walk away and Biden will be POTUS by July 4th 2009 — and then Biden will pick the next SCOTUS.
Sure, Obama seem like someone who is on the verge of walking away; barely engaged with his Presidency, he spends almost all his time on vacation. Oh wait, that was Bush.
As far as the Supreme Court, there is only one conceivable choice based on experience and judicial temperament, Judith Scheindlin.
At least Bush was a NBC as is Biden.
Obama is an NBC. Everyone knows who Obama’s father was and it was a non-issue to the voters, all 538 memebers of Congress, the Supreme Court and every recognized legal scholar. If you want to live in a fantasy world, in which Obama is stepping down, have a great time. The rest of us will stay in the real world where he will complete his term and stand or fall for re-election on his record as President.
And just IMO, I would rather have had a competent person born in China of a French mother and a Kazakh father as President than Bush.
This is all so easy for SCOTUS to stuff when the time is correct.
In the mean time please answer this question: so what other parts of the US Constitution did the election of 2008 make dead-letter law? — just tell us all now so we can start getting over it.
Again, the current person will walk away from POTUS and Biden will be POTUS.

First, what’s your real name? — before we start publicly discussing putting down a wager on a political event involving POTUS — if in fact we can legally do such a thing over the internet or whatever. Since I’m in NYS so I would have to ask someone here in law enforcement or the perhaps FBI if it is interstate trnsaction betting on the enforcement of the federal constitution regarding NBC status of POTUS by SCOTUS.

no, it certainly means yes if the FBI and state law enforcement is involved direcly in the bet that they are fully aware of what is going on here with this political game and the FBI agrees that betting on successful fixing the 2008 election to gut the US Constitution is legal — let’s agree to a bet with the FBI blessing and I will gladdly pay the $300 filing fee at SCOTUS to let them decide the issue independently of the FBI. — again, the FBI better already know exactly what the current POTUS person’s NBC status was and is now.

Just tell what state and local FBI office to send your proposed bet for review. I (an NBC) have already sent my $300 with a proposed mandamus to SCOTUS last week by registered mail to back up the duty to support and defend the Constitution of the United States against all enemies, foreign and domestic and of this constitutional bet or challenge with regards to current non-NBC POTUS ability to constitutionally nominate a SCOTUS associate justice.
Mr. Biden awaits the outcome.
