California Legislature Passes Bill Outlawing Paying Circulators Per-Signature

On August 23, the California Senate passed AB 1947, which outlaws paying circulators on a per-signature basis. The ban only applies to initiatives, referenda, and recall petitions; it does not apply to petitions for candidates or new parties. The bill now goes to Governor Jerry Brown, who has vetoed similar bills in the past.

  2. I am fiercely opposed to this bill. If Governor Brown signs it, I expect it to be overturned in court. Professional petitioners are actually less likely to mislead potential signers than amateurs. Professionals know that if they do a good job, they will continue to be hired, so they generally conduct themselves honestly.

  3. CA USA Dist Cts and esp the USA Ct App 9 Cir keeps very busy regarding the many Marx/Lenin/Stalin/Mao laws enacted in the CA regime

    — which in turn keeps SCOTUS busy

    — when the CA laws are ruled unconstitutional (often overruling the 9 Cir Donkey HACKS).

    Odds on Civil WAR II starting first in CA ???

  4. This is a terrible bill. If it passes, it will make it a lot more difficult to get issues and candidates on the ballot in California.

    If a person is going to lie, switching from pay by the signature to pay by the hour is not going to stop them from lying.

    Also, if somebody does lie, it is easy to catch them if people would bother to read the petition. Most of the time, just reading the summary is enough to catch a person in a lie. If the petition circulator won’t let you read the petition, then don’t sign it.
