U.S. District Court Won’t Prevent Maryland From Printing New Voter Registration Cards that Omit Libertarian Party

On January 31, U.S. District Court Judge Catherine C. Blake denied the Maryland Libertarian Party’s request for a temporary restraining order and preliminary injunction, as to whether the state should leave the party on the voter registration cards. This means the state will print new cards that list only the Democratic, Republican, and Bread & Roses Parties as choices. However, the form contains a blank line for applicants to register into some other party.

  1. How many voter registration forms can a party activist in the People’s Republik of Maryland acquire at any one time? Here in West Virginia, it appears to be at the discretion of the county clerks who typically mete out only about 25 to any one person. However, orders can be placed through our Secretary of State for quantities as high as 250, IIRC. I would suggest that Maryland Libertarians just start promoting themselves as performing non-stop voter registration drives, hoard the forms, and pre-fill them all out with their party name.

    What if there had been public party registration forms in 1854-1860 ???

    Is the 9th Amdt totally DEAD ???

  3. It would likely be illegal to fill out any part of a voter’s registration application, unless they were physically unable to do so. Someone may be permitted to review an application to ensure it is completed and make suggestions as to party affiliation.

  4. As a paralegal and litigant I have had cases before Magistrate Blake in the 1980’s which tells you how old she is about. Anyhow, she doesn’t like change back then and not now apparently.

  5. Judge Blake, in her oral ruling on January 31, seemed to suggest that she doesn’t think it means very much if a voter registered into a party years ago. She seems to think a voter might remain a registered Libertarian even though he or she has lost interest in the party. That is actually an empirical question. Perhaps in the evidence phase of the case, both sides might agree to a random selection of some registered Libertarians, to enable both sides to quiz such randomly-selected voter to see if the voter still supports the party.

  6. How many olde Donkey/Elephant folks who registered 30-40-50 plus years ago still *support* the current crop of Donkey/Elephant extremist HACKS ???
