Constitution Party Presidential Candidate Files Brief in California Ballot Access Case

On July 7, Don Blankenship, Constitution Party presidential nominee, filed this brief asking for injunctive relief against the California independent presidential petition requirement. Blankenship v Newsom, n.d., 3:20cv-4479.

Also, he filed this reply brief on July 15. The case will be heard on August 5.

  2. Blankenship isn’t interested in getting on the ballot ANYWHERE for any money. I just asked him about Oklahoma and he emailed back: “I am mostly leaving this effort to the Party. They are currently getting signatures in NJ, Alaska, and Illinois. We have sued in Calif. But there may be others working on it in other states too. Don”

    Then, when I asked him about filing as a write-in in West Virginia (no cost) he replied: “Probably not. But haven’t focused on it. Why do it?” To which I replied, “Uh, because you are the Constitution Party’s national presidential nominee?” Don’s response to that was: “But we need to figure out what the WV CP stands for before bringing it greater prominence in WV. It seems to me that the Party is out of touch with reality and misinformed.”

    Wow, I don’t know why he wouldn’t want on the ballot in his home state…He doesn’t seem to be a good candidate for the CP…I am sure he is a blip on the screen for the CP, he will probably go his own way after the election…Hope all is well in WV

    Right. And Blankenship’s reply indicates to me that he, and the national CP insiders, intend to withhold active national campaigning as a means to leverage state parties into submitting to the national CP yoke. If so, that’s the stupidest thing I’ve heard from them yet. The national CP holds a gun to its own empty skull, and threatens: “Don’t make me shoot.”

    The national CP has always been, in my view, more intent on maintaining control within the clique, albeit it a social group one without any identifiable purpose beyond its own amusements. A pass time, as it were. From the gentleman candidate’s response, it sounds like state CP affiliates are once again on their own under a cut and run national party policy. If that’s the case, why should state parties continue to accept such elitism and exclusion? Directly stated, why bother printing the gentleman who has arguably damaged an already failed political brand?

  6. It seems the Constitution Party nominates Blankenship because he has millions of dollars of his own money and I’m guessing they figured he’d spend some of it to get the party some attention. It doesn’t seem to be going that way at all though

  7. They can always remove the nomination from him for lack of trying and give it to another candidate. This was done with 2020 candidate, Jonannon Ben Zion who lost his status as the nominee for the Transhuman party. No big loss as this party as of now does not have ballot access to one state. Perhaps Constitution and the American Independent parties can go for a common candidate. How about JR Myers or Samm Tittle as they both have ballot access to a few states. Or be bold and give the nomination to….Kanye West. Even if he doesn’t campaign he could get more votes then Libertarian and Green parties. It is a good way to promote their parties by. Along a shock move.

    In any case it seems no one will doubt the right wing credentials of Kanye. Both are right wing parties but Constitution party seems more liberal in economic policies whereas AIP are.more populist.

  8. Don Blankenship is trying, in multiple states.

    Samm Tittle is only on the ballot in New Mexico, and, chances are, Colorado. I don’t think J.R. Myers is on the ballot anywhere except probably Colorado and possibly Arkansas.

    That’s an interesting idea, though, that the Constitution Party would consider Kanye West. I read today that he wants to bring back teacher-led prayer in public schools.

  9. Richard, any chance the AIP would nominate Blankenship in California or is there animosity between the AIP and constitution party? I know they used to have an alliance a few years back

  10. Could they have picked a worse candidate? Might as well gone full joke and called up Vermin Supreme. It was obvious he wouldn’t win the LP nomination.

  11. @Draft Vermin – no, it was certainly NOT obvious that Mr. Supreme would not win. He did remarkably well in the several rounds of voting, IMO. And BTW, Vermin is too good of a candidate for the Constipation Party.

  12. Agreed way to good, easily could of and should of win l.p. And hopefully will win lp next time. He’s not a joke candidate not a good fit for the constipation party. As for Blankenship no they could not of pick worse. He is a goober and I believe he was responsible for the mine deaths even though he skated on that and did time for lessee crimes plus he is a bigot even worse than orange Hindenburg plus not even trying to run, if you want to see a joke candidate theres a joke candidate for you straight up no doubt.

  13. Myers is 100 percent on in Arkansas. There are multiple states constitution party disafiliating from there national unit are about to if they did not already and some already did so chances are many most or even all of those won’t put blanknship on the ballot. And as far as he’s trying in multiple states which states besides where the party is paying which is not many? May be he has volunteer somewhere not getting the job done? As for aip they will run either Rocky or trump again. No they will not run Blankenship.
