On October 5, the U.S. Supreme Court heard Adams v Carney, 19-309. This is the case over the Delaware law that requires the Governor to appoint only members of parties that have at least 5% of the voter registration to judicial posts. The Family Court and the Court of Common Pleas are exempt from the law, but the more important state courts, including the State Supreme Court, are subject to it.
Most members of the U.S. Supreme Court certainly seemed to feel that the exclusion of independent voters, and members of minor parties, is troubling. But the plaintiff, who is a registered independent, may not win the case because of minor problems with his case. He had said that he would “consider and apply” for a judicial position if it were offered. It would have been better if he had no used the term “consider”. One justice said if he received an application from someone to be his law clerk, who used that phrase, the justice might feel the applicant hadn’t really made up his or her mind whether the job is desired or not. If the justices feel the plaintiff wasn’t forthright enough about wanting to be appointed to a judicial position, they may find he lacks standing.
The attorney for the state of Delaware also emphasized that the plaintiff said he wanted to be appointed any type of judge, yet he didn’t really seem to care about being appointed to one of the two low-levels of court in which the restriction doesn’t apply.
The justices asked some interesting hypotheticals. They wanted to know if Delaware could have a law requiring all judges to be registered independents. They wanted to know if the state could have a law saying the Governor could only appoint members of the largest party. They asked about a hypothetical law in which state court judges would be elected, but only Democrats and Republicans could run. The state conceded that would be unconstitutional.
The state justfies its ban on minor party members by assuming that all minor parties are “allied” with one particular major party. For example, the state seems to think everyone agrees that a Green would be ideologically identical to a Democrat. That assumption is grossly in error, not only for the Green Party, but also for other minor parties. It ignores the existence of the third-largest political party in Delaware, the Independent Party, which is a centrist party.
I am praying that justice Barrett, once confirmed and placed on the court, will convince the newly firm Republican majority of the court to amend the law to only allow Republican judges and justices who are personally appointed by our Lord and savior TRUMP to sit on the bench at any level and in any state. All others will need to then immediately retire and replaced. The oath all judges, lawyers and jurors swear will also be amended to be an oath of personal loyalty and obedience to TRUMP. Getting back to the issue at hand; I do not see any rational justification for this particular law. The problem is that if the 5% threshold is OK’ed by the Supreme Court for ballot access purposes how can they strike down this law without having to strike down the 5%?
Personally, I think that the 5% threshold for ballot access is too high, but I do not think that a majority of the justices would agree.

One of the major reasons the country as a whole does not feel the need to be fair to third party candidates is that we use an electoral system that is fundamentally broken, and I daresay undemocratic, in order to choose our leaders. Plurality voting (where you select one candidate on the ballot and are not able to express a view about the other candidates) leads to this kind of 2 party domination stranglehold. Happens in all countries that use plurality systems and we know why it is since it’s been proven that this mathematically will happen the longer the country uses plurality voting.
A shift in our electoral system to a proper voting system such as Score Voting, which is vastly less broken for a variety of reasons (detailed here https://www.rangevoting.org) would naturally lead to selections of better candidates from the Democratic and Republican parties, as well as bolster a better and more accurate representation of voices from the American people as a whole thanks to being a voting system that wouldn’t cause third parties to be completely shut-out.

The problem with Score voting is that partisans will almost always vote 5 (max) for their guys and 0(min) for anyone else, marking is more or less another form of plurality voting.
Wow you are stupid. First of all this IS THE ISSUE AT HAND!!! The initial law being challenged is that only demoncrats and Republicans can qualify. That’s a good first step because it gets rid of spoiler and joke parties and wishy wishy unaffiliated judges who have no loyalty to Party, President or Country since these are now all one and the same. But it’s not enough because it still allows for demoncrats and we can’t have that. The second problem is it only covers Delaware so what about the rest of us.
So here we do have a solution. Justice Barrett has been sent to us by God in the form of TRUMP to fix all our legal problems. She will be appointed by the Republican majority in the Senate which is already personally loyal to TRUMP.
