New York Submits Brief in Ballot Access Case

On April 9, the state of New York submitted this brief in the three ballot access cases filed by various minor parties. The state’s brief asks the U.S. District Court to uphold the new definition of political party, and also the new number of signatures for statewide independent candidates and the nominees of unqualified parties.

The state’s main point is that the old law, requiring 50,000 votes for Governor, was set in 1935, and the state has grown since then and therefore it is only logical that the vote test be increased. However, in 1936, the first year in which the new vote test for Governor was in place, there were 5,557,339 votes cast for Governor. The 50,000-vote test in effect that year was .90%. Therefore, logically, if the state just wanted to update the number of votes cast for Governor, it should have set the new law vote test at 1%, not 2%.

  2. I disagree. I vote based on the party. I’m a straight party line voter, one of many. In many cases I have no idea who the individual candidates are and no time to research them. If they have my party’s endorsement I feel confident that the people who do have that time did their job and picked someone who represents our views. Many people I know, same thing.

  3. Sage is what I call a lazy voter. Not all candidates in a party have the exact same views. The Dems for example could have a Kennedy type moderate, a socialist, and an outright communist on the same ballot running in different races. Actually, that sounds like their representation in Congress.

  5. Isn’t it interesting that over 80 years later, the vote for New York Governor has increased by roughly 10%. Which implies that the increased Governor vote requirement should only be 55,000 NOT 2.36 times that at 130,000!!

  7. Lazy and busy are two different things. I have other things to do. Not all candidates have to have exact same views. I trust my party to do a good job at selection of candidates who are better than those of any other party. It doesn’t have to be perfect. If I wasn’t busy with things I find more interesting or important I might spend a lot of time studying candidates. I’d rather spend that time on my business, family, and hobbies. Studying candidates doesn’t put food on my family’s table and it is not one of my hobbies. I’m happy to be a party loyalist, just like im happy to drive my vehicles and let professional mechanics fix them rather than spending my days off trying to do it myself.
