Arizona Supreme Court Finally Explains Why Kanye West 2020 Petition was Invalid

On June 24, the Arizona Supreme Court finally explained why it had invalidated Kanye West’s independent presidential petition in 2020. Clayton v West, cv-20-0249. Here is the eight-page opinion.

The petition was invalid because West’s nominees for presidential elector did not file statements of interest, a form that did not exist until it was created in 2019. The Arizona Supreme Court did not mention the fact that the Secretary of State’s website, which has detailed instructions for candidates of all types, never said that candidates for presidential elector must file this form. The Court simply said, the law requires candidates of almost all kinds to file such statements, and West’s electors did not, so he was properly kept off the ballot.

The Court did reject the other argument against West, that he could not be an independent presidential candidate because he was a registered Republican in his home state of Wyoming.

From now on, all candidates for presidential elector in Arizona are on notice that they must file a statement of interest. The statement of interest is to indicate that the applicant intends to be a candidate in the upcoming election, and provides contact information. The form does not ask about campaign finance. An earlier version of this post said that it is a campaign finance document, but it is not.

  1. So now they expect candidates for Presidential elector to file campaign finance reports?

    Even if they collect $0 and spend just their own car fare to get to the capitol?

    And, even tho that expense is not incurred until after they have been chosen?

    And, is this the rule for all other candidates for office in Arizona?

    Absurd.

  2. the statute exempts a few offices, and presidential candidates are exempt.

Next thing you know, someone will decide that candidates for Presidential elector have “constructively received” the contributions made to the Presidential candidate to whom they are pledged, thereby requiring them to report a proportionate share of all contributions received and expenditures made on behalf of their Presidential candidates.

  6. It sounds to me like they were looking for an excuse to disqualify the Kanye West petition in Arizona, and this was all they could come up with.

  7. That’s exactly what they did. They needed to help steal the Arizona electoral vote for Biden and the Chicoms and this is just an excuse they cooked up afterwards when they couldn’t think of anything better, after trying to for a few months.

  8. I have worked out the percentage of the vote that Kanye West received, in all the counties where he was on the ballot. His best counties were mostly Tennessee counties that had a low percentage of African-Americans in the population. So, ironically, I think to the extent that he received votes that would otherwise have gone to Trump or Biden, I think he pulled voters from Trump. Kanye West was perceived as a pro-life candidate so maybe some voters who wanted to vote for a pro-life candidate but who had reservations about Trump voted for West.

  9. I worked Kanye West petitions in two states. He had very little support among black people, even out of the ones who liked his music and clothing company, most did not think he should have been running for President. Some thought he was making a fool out of himself by running, and others thought he was just trying to siphon votes from Joe Biden to help Donald Trump get reelected.

  11. I’m voted for Kanye. I am a Caucasian hip hop fan from out on the country. We don’t have a lot of African Americans out here but many of us love their music and their displays of athleticism. Every other pickup going down the road out here is playing rap and we all love football and basketball.
