California Hearing Set for Lawsuit Over Party Label for Governor Gavin Newsom

A Sacramento County Superior Court will hear Newsom v Weber, 34-2021-80003666, on July 9, Friday, at 9:30 am. This is the lawsuit filed by California Governor Gavin Newsom to have his party label on the September 14, 2021 recall ballot. The law authorizes anyone being recalled to request that his party label be on the ballot, but the law requires the recalled official to make the request as soon as he or she is notified of the recall petition and files a response. Newsom did not file the form on time.

    The law talks about “party label” or “party preference”?

    What about the first amendment right of the Democratic
    Party in use of its name outside the window of the seven days the law gave for that use of party name.

  4. This election is going to be an unholy mess. The Secretary of State, Shirley Weber, announced an incorrect number of signatures in lieu to qualify to offset the filing fee, which may have discouraged any number of potential candidates. She announced that 7,000 would be required, but she did not take into account the reduced time available, which under California law would allow a candidate to cover the filing fee with about 765 signatures.

  5. Didn’t they just require 25 signatures during the 2003 recall? Did the law change?

    What information do you have that the Secretary of State did not take into account the requirements of CA Elections Code Sections 8106.5? She was well aware of the shortness of the dates between 1 July to 6 July and the normal date period was 55 days. Any reading of CA Elections Code Section 8106.5 would know that the number would round up to 765 signatures, Yet what we have is the Secretary of State is conducting candidates suppression in the recall election of Governor Newsom.
