California State Appeals Court Rules that Independent Voters Have No Constitutional Right to Participate in Partisan Presidential Primaries

On March 21, the California State Appeals Court, 4th district, division one, issued an opinion in Boydston v Padilla, D080921. It is 24 pages long and can be seen here. It says that independent voters have no constitutional right to vote in partisan presidential primaries. Some California parties do permit independent voters to vote in their presidential primaries, but others do not. Each party decides for itself before a presidential primary is held. The plaintiffs argued that independent voters must be permitted to vote in any party’s primary, regardless of that party’s wishes.

Generally the California Democratic Party permits independent voters to vote in its presidential primary, whereas the California Republican Party does not, although it did permit them to do so in 2004.

  1. The American Independent Party of California also has generally allowed the Decline to State/No Party Preference voters to vote in its Presidential Primary.

  5. This is a great ruling. It reinforces the principle of the associational rights of political parties recognized in Eu v San Francisco.

    Given that it was rendered in a case about primaries, it could serve as the basis of a constitutional challenge to top-x primaries

  6. I’m self employed. What are you babbling about? I don’t work for Prigozhin, and am barely aware who he even is. I don’t know who the other two are without looking them up. I’m not government intel of any kind and never claimed to be. Wagner Group is pretty cool, but I’ve never worked for them, and highly doubt I could qualify if I tried to sign up. I don’t know what I ever said to make you draw those conclusions or more accurately, make up lies with no basis regarding me. Mezh proch suka, Sam poshol. Rather than to dignify that, dorogoya boryachka, I shall just inquire as to whether you name yourself after our drunkard former president, or whether perhaps you are bored enough due to lack of imagination and interests. Ever try duolingo? Chess online? Solving mathematical puzzles? Exploring Google earth? Turning sound function on in accessible internet within your browser or phone settings and making the vast repositories of original works and other things you may wish to learn online your own books on tape if you need to keep your eyes on the road or whatever?

    How about…Training your mind and body in countless ways you can at any free moment or while multitasking? Learn day trading? Make deals of some sort or work a first or second job, depending if you have a first, on phone or online? Make a business? Ever try Khan academy or anything similar? We can just keep going. Anyone who is ever bored these days should search his own soul or mind or both as to what is wrong with him.
