On April 19, the Arizona Secretary of State, Adrian Fontes, a Democrat, filed this brief in Arizona Democratic Party v No Labels. The case is in Maricopa County Superior Court, cv2023-4832.
The brief defends the Secretary of State’s determination that No Labels is a qualified party in Arizona. It points out that the statute contains no provision for anyone to challenge the petition of a newly-qualifying party. It also points out that the law does not demand that affidavits from ten persons (requesting that the new party be recognized) be filed only after the petition is filed. And it makes the point that the wording of the affidavits is not spelled out in the election code.
Finally, it says that even if it were true that the affidavits should not be filed until the petition is complete, No Labels appears to have had enough valid signatures collected before the affidavits were filed.

Also gives Senator Sinema a way to keep her seat…. Since she is no longer a Dem she basically would have no way to get on the ballot if No Labels did not exist.
She could do an independent petition. Or a separate party petition she actually controls, whichever is easier. Speaking of control I asked a question about that in a different thread. I don’t want to have the same conversation twice but if it doesn’t get answered there I can ask again here.

Burt You need a ton of signatures to run as a Independent in Arizona. Very difficult to accomplish. Much easier to win a No Labels primary likely against a few no name candidates.
It’s probably not difficult to accomplish when you have a lot of money and name recognition, like when you’re the sitting senator and a national scene player with supporters around the country. But even if it is, qualifying a party is also an option, unless it’s past the deadline. Whether either of those is an option here or not, my question from the other thread still stands.

Richard so far in arizona the no labels party has 342 registered voters in Maricopa County and 34 registered voters in pim a county in not sure about the other counties.
The no labels party is another Ackerman and probably Bloomberg front group.
