New Jersey Won’t Respond to Cert Petition Filed in New Jersey Ballot Labels Lawsuit

On May 25, the New Jersey Secretary of State told the U.S. Supreme Court that she does not intend to respond to the cert petition filed in Mazo v Way, 22-1033. Of course if the Court asks for a response later, she will respond.

Two more amici on the side of the candidates who brought the lawsuit were filed on May 25. Here is the brief of Michael D. Byrne, a New Jersey Republican official.

Here is the brief of four New Jersey law professors, also on the side of the candidates.

New Jersey Won’t Respond to Cert Petition Filed in New Jersey Ballot Labels Lawsuit — 16 Comments

  1. Because not everyone clicks on the links:

…in petitioner Lisa McCormick’s case, her political rivals in 2020 obtained a Certificate of Reservation for the
corporate name “Not Me. Us.” so that they could use that slogan on the ballot and prevent McCormick from using it. But after the primaries ended, her rivals did not bother to incorporate an entity with that name and today there is no corporation in New Jersey named “Not Me. Us.”

They’re trademarking ballot slogans. Something is off about this whole situation.

  2. Someone needs to reserve “I trademarked this cool ballot slogan” Inc.

    😉

  3. MORE SLOGANS —-

    VOTE FOR ME.

    JOHN DOE IS A TRAITOR.

NEW JERSEY – GREATEST OF ALL TIME [GOAT]

MIGHT OUTDO LITTLE DE WITH ITS FAKE CORPS ???

  4. HOW MANY STATE / FED LIMITS ON NUMBER OF LETTERS/SPACES IN PARTY NAMES ON BALLOTS ???

ANY *** MAKE AMERICA GREAT AGAIN *** PARTY / TRADEMARK / COPYRIGHT ???

  5. Getting rid of ballots and having a standing vote count eliminates this problem, among many others.

  6. The state is missing an opportunity here.

They ought to charge for slogans, based on the character length of the slogan.

The slogan, thus, becomes an ad that helps pay for the costs of producing the ballots.

  7. ELECTION COSTS

    0.1 PCT OF GDP ???

HOW MUCH GOVT NET INCOME FROM GOVT LOTTERIES ???

  8. Poll (election) tax should pay for peace officers, head tax for military. Each collected by the two respective branches. Volunteers (not paid) and voluntary contributions should supplement both. Hopefully, peace officers would be part time. A tax on the movement of people and goods between precincts, and especially between military national defense areas, could be collected by both and go to both.

  9. MIN/MAX SIZES OF PRECINCTS — ???

    AREAS / POPULATIONS ???

A-N-Y SUCH PO/M SYSTEM IN RECORDED WORLD HISTORY ???

  10. So far I’ve only guesstimated around 100,000 humans per precinct and about 100 voters (1 per 1000). They can subdivide in case of population explosion, but I think population will be pretty stable. No such system in history, much as with your own proposal.

I’d prefer if you stopped talking to or about me, as you have become excessively tiresome. I think I’ll leave very soon, regardless. Seems a bit stale here, and looking like time to move along.

  11. @Max,

The US used to have viva voce elections. The English settlers brought their electoral traditions to the New World. People from different areas settled in different areas based on their motivation: religious, mercantile, etc. They came from different areas in England.

In the American South they tended to vote by voice instead of secret ballot. When Congress was legislating the manner of Senate elections by the Legislatures (prior to the 17th Amendment), Northern congressmen advocated for secret ballots. A representative from Kentucky wanted open voice votes, like he had been elected, and the legislators had been elected.

  12. South > north when it comes to the modern United States, although it is my understanding that voice votes are still not uncommon in New England town meetings, party and other types of conventions, and caucuses in at least some states. Thank you for the additional history. Still interested in reading a more substantial response from you regarding Dooley’s criticism of technically nonpartisan elections.

  13. HOW MANY GOP FOLKS SURVIVED PUBLIC VIVA VOCE VOTES N 1854-1860 IN SOUTHERN SLAVE STATES ???

THEN HAD TO FLEE TO SURVIVE ARRESTS / HANGINGS / SHOOTINGS IN 1861-1865 ???

    — UNTIL UNION ARMY/NAVY SHOWED UP TO LIBERATE FOLKS FROM SLAVER TYRANTS.

  14. My guess would be zero, unless you have some evidence that such a thing even happened at all. But then you are the guy who thinks the biggest difference between Trump and Hitler is that Trump hasn’t been to jail or prison, which you think he will. Never mind little things like an 8 digit body count, invading nearly every country in Europe and its North African colonies, leaving his country a bombed out wreck divided and conquered by enemies in war, etc.

You’re also the guy who may be obliquely claiming to be God with your screen name, but won’t forthrightly confirm or deny that is what you are doing, instead weaseling out like the wannabe lawyer you are. You also think the FBI is going to be arresting people for using the same two letter combination as their screen name, as if you own it or they have nothing better to do. Among many other ridiculous assertions you make on a regular basis.
