Moore v. Harper decision issued by SCOTUS

On Tuesday, June 27, 2023, the US Supreme Court issued its opinion in the Moore v. Harper case out of North Carolina. The issue was whether the NC Supreme Court went beyond its authority in rejecting the NC legislature’s US House redistricting plan after the 2020 census due to unconstitutional pro-Republican Party gerrymandering.

  2. The Court wrote in its Syllabus: “The Court need not decide whether the North Carolina Supreme Court strayed beyond the limits derived from the Elections Clause, as petitioners did not meaningfully present the issue in this Court.”

    Translation: If the people of NC don’t like what their own Supreme Court did, that’s THEIR problem.

    Standing, and proper form are essential features of Supreme Court appeals. Lawyers who submit stuff to the court need to do their homework. Otherwise, the Supremes will give you a D- or F.
