Minor Parties and Independents File Notice of Appeal in Texas Ballot Access Case

On August 5, the minor parties and independent candidates who are challenging Texas ballot access laws filed a notice of appeal to the Fifth Circuit in Miller v Doe. This is the lawsuit filed in 2019 over many Texas ballot access laws.

The U.S. District Court had already upheld all the challenged laws, except for the provision that electronic signatures are not valid. The U.S. District Court had issued a final order on June 26, declaring that Texas must let independent candidates and minor parties use electronic signatures. The state then appealed that.

Because the state appealed the part of the case it lost, that meant the minor parties and independent candidates had a right to file a later notice of appeal for the parts of the case they lost. So all aspects of the case now go to the Fifth Circuit.

  2. I am loving this third party and independent unity on the issues that are held sus by the two-party system. They have become my reminder for why the United States is the greatest nation in the world, despite its flaws.

  3. Your yelling is getting what accomplished? Contrary to your delusions this isn’t 1775 or 1860 or anything close. Even if it were, you are a lone crank posting endlessly in a website with as far as can be determined zero followers. You refuse all advice on how to go about persuading people or even making yourself understandable to most readers. You insist you’re right about everything and call everyone who disagrees or asks probing questions various insults such as troll morons etc.

    Add yelling and you are doing the exact opposite of persuading anyone, much less starting a revolution. If the British were always “coming,” Paul Revere would soon find himself habitually ignored or laughed at, like the boy who cried wolf. Then if the wolf or Brits actually arrived he would still be ignored.

    Equally, if there has been continuously “rot” and nothing new in 6,000 plus years, the sky can’t be falling, and no sense of urgency attaches. Then you’re unclear on whether or when the “dark ages” ended, New age began, etc. Try defining your “ages” – when they begin and end, whether they overlap. Is there continuous rot, continuous progress, or both? Which predominantly? Is the sky falling, doom impending, or nothing new in over 6,000 years? Logic dictates it can’t be all of these things at the same time.

    Rote repetition and yelling isn’t a way to convince people. Gratuitous insults endlessly, failure to offer evidence, unwillingness to admit error, no consideration of contrary arguments or evidence, frequent use of little understood jargon – all ways to measure you win no converts.

    Yelling may have its time and place. All the time isn’t it. Ask yourself what progress you’ve made in getting others to file lawsuits, gaining relief from the courts, getting anyone to sponsor ballot initiatives you propose, or creating any sort of organization, movement, or followers of your idiosyncratic beliefs. Peddling ever harder only gets you stuck in the mud, and further redoubling your efforts again and again after that only cements you there further.

    I don’t particularly mind, since I don’t agree with you about either an imminent crisis or your proposed solutions to avert one, no matter how imminent or remote. But if I did believe a crisis were imminent and I had the answers, I’d all the more owe the future an honest attempt to persuade people. You do the exact opposite, which is why you are a troll moron. Aside from continuous self contradictory statements and repeating even the most ridiculous thoroughly debunked utterances , you studiously avoid all actual attempts to winning converts or persuading anyone. Ergo, your stated beliefs are not sincerely held, or you lack even the most rudimentary common sense in the art of persuasion, or both.

    In other words, you’re a troll moron. It’s a fact that proves itself.

  4. It’s debatable what else might have been reasonably done in 1776. In 1861, a clear alternative existed, one actually successfully employed throughput Europe and the Americas, where slave owners were paid to free their slaves, and freeing them was made compulsory.

    War only resulted in Haiti and the United States. In Haiti, the entire White population was massacred, and the nation has been a basket case ever since. In the US, more treasure was spent on war than it would have taken to compensate owners of property which was at the time legal, regardless of your love of ex post facto remedies for legal facts you find detestable. For most slave owners, who only owned one slave or two, it was a major part of their net worth. Of course they wouldn’t accept freeing slaves without compensation.

    Much property – land and capital goods – was destroyed or damaged, and many people were killed and maimed. In the end, Jim crow and sharecropping restored something not too different from the status quo ante. But not before the precedent was set for many trespasses against constitutional rights, rule of law, state and local sovereignty, etc. Free men have been gradually enslaved as a result.

    Yelling didn’t accomplish anything good in the 1860s. Slaves could have been freed without it. Abolitionists had a better plan when they earlier advocated for the northern states to secede first. Without the fugitive slave acts, and facing growing condemnation from Europe’s markets for cotton and related products, slavery would have soon been doomed without all the bloodshed.

  5. James, further, how would it prove the US is greatest in the world? In some ways it is, in others far from it. When it comes to ballot access and true multipartisanship, many nations are better than the US. Please explain which other measures you are using.

He’s just a lonely old man who failed, and now needs to continuously reassure himself he is right, regardless of what anyone else thinks.   8. SP is right about the unCivil war. Imagine in 2060 society decides animal rights should be enforced, and pets and farm animals freed. Should the former owners thereof be compensated for their loss due to change in social mores? They were after all in possession of legal property.

    I’ll apply this even where I personally find a practice detestable. For example, I believe abortion is murder, and glad to see increasing numbers of states agree legally. Even so, it would be unjust to prosecute abortionists for what they did when it was legal, and where they must shutter their abortuaries due to changing laws, it’s wrong to take their formerly legal property without compensation. Make no mistake, I think abortionists who flout laws against abortion should be executed as cold heartedly as they kill babies, and their bodies thrown out in the trash without ceremony, as they habitually do to innocent babies they slaughtered wantonly.

  10. There are no magic troll plans for that unless you’re finally acknowledging yourself to be a troll moron. You start by falsely assuming others agree with you about a catastrophic current state and what exactly is wrong with it. You proceed to arrogantly list your hobbyhorses and once again incorrectly assume, or at least try to claim, that others are, like yourself, troll morons with “magic” plans. Some of us are none of those things, your insistence otherwise notwithstanding.

    Try asking more intelligent questions, and better still answering some questions yourself. You’ll find several of them above. Your failure to do so merely further underlines your lack of intelligence or even rudimentary understanding of your own constantly regurgitated pabulum.

  13. Well SP, I would certainly say foreign policy issues. Such as abolishing NATO, not getting involved in wars such as the russian-ukranian conflict, and freeing whistleblowers such as Julian Assange and Edward Snowden.

    I do agree with you SP that our ballot access laws in the United States suck compared to other nations. I’m not disputing that at all. And I’m talking about unity against the establishment on behalf of our freedoms. I’m sure there are some nations that are able to function multipartisanship very well. But other nations such as Canada, Germany, and the UK have shown that it is very tough to handle.

  14. I guess you’re not counting “third parties” like “no labels” or Evan McMuffin and whatever he called his. Or for that matter some of the candidates the Libertarians ran – Bob Barr and Bill Weld come to mind. Other countries have parties with those stances too, often with seats in parliament. I won’t found Amash or Ron Paul since they were never elected to Congress as Libertarians, although Paul once ran for President as one and Amash finished his last term in congress as a Libertarian. Likewise Cynthia McKinney, although she ran for President as a Green, was always elected to Congress as a Democrat.

    In what specific measures do you see the US as the best? Are they enough for an overall undisputed title in your view?

    Incidentally, I’m not even sure multiparty parliaments are better. My point was only that if you do count easy ballot and multiple parties in government as an important and positive thing in ranking countries, it’s not a good point for the US.

    I propose equal election access laws;

    No caucuses or primaries, although the general election would be held in the style of a caucus or town meeting ;

    No legislative bodies, so minority gerrymanders would be a moot point

    Government units small enough to not need districts at all, and irrelevant enough to people’s everyday lives that no one would bother jockeying for position – government service would be seen more like most Americans view jury duty ;

    No tyrants or monarchs.

    They’re not the top 5 problems as I see them, but I propose to solve them nevertheless.

  22. Bidenomics is a ghoulish term. Imagine Herbert Hoover running for a second term on the strength of Hoovernomics, if Hoover was 81 with severe dementia and a Nazi quisling puppet installed after a rigged election. All is fine in Airstrip Two and we’ve always been at war with Eurasia.
