  1. No. Pennsylvania lost a federal lawsuit in 1984 over the minor party and independent candidate petition filing dates. The court said until the legislature fixes the unconstitutional early deadline, the deadline will be August 1. The legislature has never amended the law so the court order from 1984 continues in force. It was a consent decree.

There has never been a state legislature as bad as Pennsylvania when it comes to passing bills to fix laws that had been struck down. Seven election laws have been declared unconstitutional over the past 40 years that the legislature has never fixed.

  2. SHOULD BE AUTO REPEAL IF UN-CON IN FINAL COURT CASE.

SUE FOR $$$ DAMAGES MIGHT GET UN-CON LAWS REPEALED ALSO.

  3. I ask because the office of the Secretary of the Commonwealth told me they could not tell me the starting date for independent candidates. I wondered if it wa because it was linked to primary, but I guess it has to do with pending legislation.
