Bloomington, Indiana Independent Mayoral Candidate Denied Ballot Access Due to Voter Registration 7-Day Waiting Period

Independent Joe Davis last week was denied a spot on the upcoming November 7 ballot for Mayor of Bloomington, Indiana, because he gathered new voter registrations while petitioning but did not turn the registrations in for processing at least seven days before turning in the petitions that the newly registered voters had signed. Because of this, many signatures of newly registered voters were deemed invalid, and Davis ended up with fewer signatures than he needed to make the ballot. Davis v Morales, Monroe County Circuit Court, 53C08-2308-MI-1910.

Here is a story on this matter.

In 1970, a 3-judge U.S. District Court struck down a New York law that said newly-registered voters could not sign a petition. Socialist Workers Party v Rockefeller. The U.S. Supreme Court summmarily affirmed that decision, so it should be binding on the entire nation. 400 US 806.

    The 5th Circuit Court of Appeals expanded an injunction issued in September to include the Cybersecurity and Infrastructure Security Agency, ruling that it used frequent interactions with social media platforms “to push them to adopt more restrictive policies on election-related speech.”

  2. If a candidate messes up on the ballot access qualification in the first place than they are too stupid to be elected Duh!!

  3. I don’t think that’s true. The laws are insanely, excessively complex and unevenly applied, as well as discriminatory against candidates with fewer resources to begin with. Being sufficiently well off to pay compliance experts, get favorable treatment, sue or bribe your way out of noncompliance enforcement, or being hooked up with the political machines which exempt themselves from signature collection requirements, etc, is not necessarily a sign of greater intelligence. It could be a sign of better luck or greater ruthlessness or some combination of things.
