Utah Agrees to Extend Independent Presidential Petition Deadline to March 5

On December 7, Utah state officials agreed to accept independent presidential petitions at least as late as March 5. The state filed a stipulation in the lawsuit Maxfield v Henderson, 4:23cv-112. The statutory deadline has been in early January since 2022, although before 2022 the deadline had been in August of election years.

The lawsuit had been filed by Robert F. Kennedy, Jr., and some voters who support him.

  1. What about 3rd parties? GP could use an extension as well if we didn’t meet our quota with what we handed in for the Nov30 deadline -which is even worse than the indpendent deadline.

    March deadlines have been struck down in court. Is there court precedent in Utah’s circuit? Richard would know.

  3. Unless I forgot something, under the Max plan, a party only needs to physically show up for an election to qualify.

  4. You forgot something. I previously said a party captain should be available for some months for questions. In light of the recent thought that standing alone should be an option, perhaps I should rethink that. However, for the time being it’s an effective “deadline.”

  5. Something else to consider: the right of a group to refuse admission to others who seek to join it.

  6. The ballots won’t be printed before the major parties make their nominations. Why should deadlines for third party or independent candidates be any earlier than that? Sore losers? Let the voters decide who the sore losers are.
