On February 6, the Hawaii Senate Judiciary Committee passed SB 2392 by a vote of 3-2. The two “no” votes included the lone Republican on the committee (Senator Brenton Awa) as well as Democratic Senator Mike Gabbard.
In Hawaii, legislators can vote for a bill “with reservations”, or they can simply cast a normal “yes” vote. One of the three Democrats who voted for the bill, Senator Joy Buenaventura, voted for the bill “with reservations.”
The bill bans insurrectionists from the general election ballot. Hawaii doesn’t have presidential primaries.
MERE STATE LAW CAN N-O-T DISQUALIFY CANDS IF QUALIFS FOR OFFICE ARE IN A STATE CONST.
This flies in the face of The Delarstion of Independence.
This country was founded by insurrectionists and secessionist.

The bill includes a provision that also excludes candidates on the basis of:
“Another constitutional or statutory provision.”
So, presumably, the list of exclusions could be expanded.

That provision would be for other offices. In Texas, some offices have exclusive qualifications in the Texas Constitution (examples Governor, legislature), while lesser offices qualifications are in statute.

The bill provides for a preponderance of evidence standard, so obviously it does not require a criminal conviction or 5th and 6th Amendment protection.
