U.S. District Court Upholds Wisconsin Law Requiring Absentee Voters to Find a Witness to Watch Them

On May 9, U.S. District Court Judge James D. Peterson, an Obama appointee, upheld a Wisconsin law that says when someone votes absentee, the voter must find some other adult U.S. citizen to watch the voter vote, and then the witness must sign the outer envelope, give his or her address, and certify that the the witness observed the voter prepare the ballot. The witness is not supposed to watch how the voter votes, just that the witness saw the voter seal up the ballot in the envelope. Liebert v Millis, w.d., 3:23cv-672.

    From the steps of the Capitol, Speaker of the House Mike Johnson (R-LA) called on Congress Wednesday to pass his new “election integrity” bill, which he claims will prevent noncitizens from voting in federal elections.

    The Safeguard American Voter Eligibility (SAVE) Act proposes that anyone registering to vote in U.S. elections must first provide proof of citizenship.

    This would be an amendment to the 1993 Voter Registration Act, which mandates people fill out a form swearing they are U.S. citizens but does not require documentation.

    If passed, hopeful voters would need to prove their citizenship with a passport or birth certificate.

    If the bill passes and is enacted, states will have 10 days to implement the new voting registration requirements.

Instead of abolishing all absentee ballots entirely, which is silly disenfranchisement, make mail-in ballots at least as secure as UOCAVA ballots are currently (i.e. restrict legitimate reasons for applying for a mail-in ballot, set strict deadlines for applying without any automatic renewal, require proof of identity upon applying and upon voting, etc.).

    Currently only AL, AR, CT, DE, IN, KY, LA, MS, MO, NH, SC, TN, TX and WV even require you to provide a reason for applying for a mail-in ballot. Most states will give you a mail-in ballot upon request without any reason. And CA, CO, HI, NV, OR, UT, VT, WA are just sending out mail-in ballots to everyone by default.

    Absentee ballots don’t have to be an opening for fraud, if they don’t want them to be.

    Some countries use flying squads for voters who are unable to appear at the polls.

    The federal government should issue ID’s to all citizens and all lawful residents.

    For citizens they would inform election official in the state of residence. This would replace the need to register. If a person moved they would update their address.

  8. Making mail ballots secure is impossible. There’s no way to know who’s standing over voter filling out a mail ballot, possibly in an intimidating way.

    That argument applies at least as much to in-person voting. How often have we not seen polling stations besieged by gangs trying to intimidate voters? And nothing ever gets done about it.

  12. A voter can go into the voting booth alone much more easily. You should look into the reality of vote harvesting operations more. I’m not even referring to anything illegal.

  13. Where do you think voter intimidation happens more, at the polling station or in the privacy of ones home? You should look into the reality of voter intimidation and poll worker corruption more. Mail-in ballots have the potential to be at least as secure as in-person voting and likely much more so, if only they were actually interested in election integrity – which they clearly aren’t.

  15. As have I. If you actually think that in-person votes (let alone standing votes) as they currently are, are less susceptible to fraud than UOCAVA votes as they currently are, then you have nothing meaningful to contribute and should probably be stripped of your right to vote.
