On August 8, We the People Party, the party that supports Robert F. Kennedy, Jr., filed its brief in its North Carolina ballot access case. The case, North Carolina Democratic Party v North Carolina State Elections Board, attempts to remove the party from the ballot and is filed in state court. The Democrats argue that the party is a “sham” party because its real purpose is to put an independent presidential candidate on the ballot. We the People says the First Amendment doesn’t permit the government to decide what is the purpose of a party, and furthermore that at least five times in history, other independent presidential candidates, or groups supporting an independent presidential candidate, formed a new party and got on the North Carolina ballot that way.

If the party of “save our Democracy” wins in 2024 they will be the only party on the 2028 ballots.
That’s unlikely. If we were to somehow defeat the Republican menace once and for all, which is probably way too optimistic for a four year time frame, parties further to the left would no longer be a menace of the fascists dividing and conquering us. What would be more plausible under such a scenario would be multiple parties with one dominant party and effectively multiple parties working as factions of the dominant party, like the decades long heydays of the LDP in Japan or PRI in Mexico.
But far more likely we would just have a JD Vance or some other post Trump MAGA menace leading squadrons of the same in trench warfare up and down the ballots yet again.
And furthermore, We The People is running a couple of downticket candidates.
The lawsuit still has value, even if only ancillary.
