Cornel West Wins North Carolina Ballot Access Lawsuit

On August 12, the Justice for All Party won its North Carolina ballot access lawsuit in federal court.  Ortiz v North Carolina State Board of Elections, e.d., 5:24cv-420.  The State Board of Elections had rejected the party’s petition even though the county boards had said it had enough valid signatures.

The Democratic Party and the State Board of Elections had said the petition should not be approved because a small sample of the voters said they did not remember signing the petition, but the opinion says that is not persuasive.  Also the opinion says there is nothing illegal about outside groups helping a new party to collect signatures.  The decision is by U.S. District Court Judge Terrence Boyle, a Reagan appoointee.

  1. Not yet known. Most likely court case and appeals will be the next stages of this game.

  2. Well lets hope for that. Nonetheless, this is some good news in North Carolina. We need more options if we want to have a chance to have a better state.

  4. Of course I do, that’s very important to me. We really need to change the ballot access laws so that we can have more options in the long run. We also do need to change the culture that is against third parties. I especially care after what happened to the Veterans Party of North Carolina when they got screwed by a rogue petitioner and the Forward Party is currently petitioning in NC with their filing petition due on the June of 2026. Just because I’m happy about the outcome of a political party having ballot access doesn’t mean I am not hoping they’ll be able to retain it.

So, you just don’t believe Trump when he says he will be a dictator starting on day one, be his crowd’s retribution, have a bloodbath, or induce any more insurrectionists (whether he’s in power or not). Or maybe you believe him that he does not know anything about project 2025. Or his and his friends beliefs, frequently stated and defended, that the president should be above the law, that federal employees should be hired and fired based on their loyalty to the president (along with federal judges, who will share some version of this view), that news organizations should not have the right to disseminate what the President believes are lies, that law enforcement should have absolute immunity in addition to being openly politically directed –

    Etc, etc.

    Have you ever studied the case histories of how free society’s turn into dictatorships?

    Trump is following that playbook, and don’t let his first term fool you. He’s much worse now, and much more capable of carrying out those kinds of plans.

    Having third party choices is nice, but not when that enable none of us having any political choices beyond this election, which is what a Trump victory would mean.

  6. Anybody who believes that voting Democrat or Republican will help third parties or the country in the future is foolish. Voting for third party for president or governor in this election will actually have impact as those races are ballot access races in North Carolina. The Democrats and Republicans have already made it clear that they will not save us because they have both taken pride in attempting to kick candidates off the ballot for not bowing down to the system across the country. There is no perfect plan to stop dictatorships, but the first step to have any hope of stopping that is to stop voting D and R. The democrats do not deserve to be called the party for democracy anymore. The republicans do not deserve to be called the party for freedom anymore. Change can not be formed by within.

  7. Only Trump plans to install a dictatorship. With Democrats you live to fight another day politically. With Trump in office, the only fighting you might get the option to do is of the guerrilla warfare variety, if you’re not killed or thrown in a dungeon first.

  8. That’s not what many North Carolinians saw in North Carolina in regards to the democrats. What we instead saw from the Democrats were corruption, dictatorship, and calls for the three democratic board of election members to resign. Many of the third parties are still upset about the delays caused by the democrats and what the democrats did in 2022. Some people even left the Democratic party in the aftermath of the 2022 scandal. There is no respect for Marc Elias within the third party movement and there is no respect for the state board of elections due to their manipulation tactics.

  9. I don’t think you understand what a real dictatorship is. Have you ever been to a dictator run second or third world country? It’s insulting to compare US politics to that. But it won’t be if Trump 2.0 happens.

  10. If the Democratic leadership in your state ran the kind of dictatorship we are talking about, there would be no second or third parties of any kind on the ballots at all. Or they would be run by stooges with the dominant party getting 90% in every election and the real opposition tortured or worked to death in dungeons, exiled overseas, disappeared, or literally out in the woods fighting for survival.

    Please stop the hyperbole comparing your situation to that.

  13. “… is stock” is a cowardly troll of many names who always invariably claims that anyone from the left or center is Stock. He never has any evidence to back this up. He also claims anyone who points this out or questions it is Stock Also with zero evidence.

    Stock supports Kennedy. Rad doesn’t even want to allow Kennedy on the ballot. I’m not either one of them, or even on the left at all. I’m actually way to the right of Trump. But this weird troll will still say I’m stock because I’m pointing out his bullshit.
