Democratic Party Threatens to Sue Virginia Board of Elections if Cornel West is Not Removed from the Ballot

On September 11, the Elias Law Group, which represents the Democratic Party nationally, threatened to sue the Virginia Board of Elections if the Board doesn’t remove Cornel West from the ballot. See this story. The legislature changed the presidential elector paperwork this year, and the new law went into effect July 1, 2024. The Cornel West used the old forms, which the Board had furnished to them.

  1. The Elias (Scoff)Law Group, attacking and undermining the First and Fourteenth Amendment rights of people opposed to both ruling parties and thus “saving” free and fair democratic elections by making them less free and less fair.

  3. According to the article, the Virginia Legislature passed a law this year that requires that each Elector for President pledge that he or she is a US citizen and legal residents of Virginia.

    I don’t know what it says in federal or state law, but in the US Constitution, the requirements to be a Presidential Elector are:
    -Chosen by the state
    -Can’t be a Senator or Representative
    -Can’t have engaged in insurrection or rebellion (14th Amendment)
    It does not require the Presidential Elector to be a US citizen, nor a legal resident of the state that chooses them. Just thought that was interesting.
