Maine Legislator Asks U.S. Supreme Court to Restore Her Ability to Cast Votes in the Legislature

A Maine state representative, Laurel D. Libby, has asked the U.S. Supreme Court to restore her ability to cast votes in the legislature. She lost the ability to vote in late February 2025, because she refuses to apologize for her statements about the issue of whether it is fair to let transgender women compete in high school sports. Libby then sued the Speaker of the Maine House so that she can again vote, but she lost in U.S. District Court and in the First Circuit.

Her U.S. Supreme Court filing is here, and was filed on April 28. Today the Court asked for a response. The case is Libby v Fecteau, 24A1051.

    Of course, the benefits of what two persons do for their mutual benefit one day can become a mutual detriment by the intervention of the State the next day.
    Consider voting, what benefit a voter sees in electing a person to hold office for a limited term can be undone after the election by incumbents passing laws to nullify the voter ability to choose as the voter sees as most beneficial in all future elections. Individuals chosen to hold office become indentured servants of that small minority with the power to nullify the elected from serving the interests of those who elected them.
    This is the fundamental intent of all ballot access laws – censorship of alternatives to the incumbents and the incumbent parties.

    But being ruled by government is not voluntary in the first place. I guess you can say that voting implies consent, but what about all the people who don’t vote?

    Anyway, you shouldn’t hand over the keys to the voting process to the people you voted in. They shouldn’t be able to make ballot access laws in the first place. Perhaps the government shouldn’t be printing ballots at all.

  24. If there are no ballots there can be no controversy over who prints them or what’s on them.
