On January 16, the five presidential elector candidates for Shiva Ayyadurai in Nebraska filed this request to the U.S. Supreme Court for more time to file their proposed cert petition. Their petition in 2024 for independent presidential candidate Ayyadurai had enough valid signatures, but the Secretary of State refused to put him on the ballot as an independent because he was born in India. The Eighth Circuit last year agreed with the U.S. District Court, which had ruled in favor of the Secretary of State.
The electors want to try to persuade the U.S. Supreme Court that they should have been allowed to run. Ayyadurai himself is not on the case. Lauters v Evnen, 25A834.
The only time the U.S. Supreme Court ever accepted a ballot access case in which only presidential elector candidates were plaintiffs was 1969, in Moore v Ogilvie. This was an Illinois case. The electors had to claim they were unpledged. They really wanted to support U.S. Senator Eugene McCarthy as an independent presidential candidate, but they couldn’t because McCarthy didn’t want to run and therefore had nothing to do with the lawsuit.
I do not think he should have been on the ballot for President because he is not a Natural Born citizen and the US Constitution says that to be President one must be a Natural Born citizen.

The right to vote is more fundamental than the Constitution itself. The right to vote is what ratified the Constitution. Voters and their Electors have the pre-constitutional right to vote for anyone; however, by doing so in a constitutional election, the U. S. House of Representatives can disallow electoral votes for a person who does not meet constitutional qualifications for President so they cannot take the oath of office and assume office. The U. S. House has the sole power to enforce the qualifications clause for the President and the Senate for the Vice-President. Those powers cannot be delegated to any other government authority.
There is no point in placing a candidate on the ballot who is not legally eligible to hold a political office.
A candidate is just a label for a group of electors pledged to vote for that candidate and express some sort of statement by doing so. There are many reasons that candidates can’t serve, including age, no longer being alive, and not being on enough ballots to win. That determination should be made by congress when it accepts the votes of electors, not by states printing ballots. Allowing states to intercede in that process gets them into the morass of who is or isn’t natural born, who did or didn’t commit insurrection, etc. States don’t belong in that process for labels on groups of presidential electors, which don’t even necessarily have to be a person – for example, unpledged electors,a pig or other animal to make some sort of point, etc.
I agree with Randy. Letting secretaries of state make these kinds of determinations for a presidential candidate is asking for trouble, and leads to nonsense like several states wasting the valuable time of President Trump and his campaign by trying to keep him off the ballot.
The proper remedy for Ayyudarai is deportation. Even if he is naturalized, he should be denaturalized and deported for the crime of fraud ,that fraud consisting of presenting himself as a presidential candidate. But secretaries of state should have nothing to say about it. Only congress when the votes of electors are counted.
I like the idea of deporting all criminal aliens, including misdemeanors. If they have been naturalized, that should involve denaturalization, and birthright citizenship should be retroactively stripped from the children of illegals. Being present in the country illegally should also be sufficient for immediate deportation. I would also denaturalize and deport any citizen who provides illegals with housing or employment. And any legal resident or naturalized citizen ever convicted of any crime (felony or misdemeanor).
100 million deportations would be a great start. Let’s make it happen!
We have to treat the alien invasion as a life threatening form of aggressive malignant cancer and take any and all extreme measures to remove it before it kills our homeland. We must cut out all vestiges of it and completely cleanse our country of the infection. Our genetic heritage is the single most important thing to preserve in the world, far more important than any of our individual lives or any sacrifice that we will have to endure to purify ourselves.
To the extent we’ve become ever more of a democracy through overextended voting rights since 1776, that has made things worse, not better. A full blown democracy would quickly result in full blown communist tyranny as the moronic majority vote their rights away for a handful of other people’s money.
Way too many morons and parasites are allowed to vote.
