On March 26, a California state trial court refused to put Butch Ware back on the California primary ballot. Sacramento Superior Court, Ware v Weber, 26WM000074. An appeal is planned. The court order merely says that Ware’s request is denied “for the reasons stated in the oral argument”.
See this news story, which says that the judge skirted the issue of whether the tax returns law is unconstitutional. The law had been passed in 2019 and it covered presidential and gubernatorial candidates, but the part of the law relating to presidential candidates was struck down that year by both the State Supreme Court and a U.S. District Court Judge.
The real reason: he’s a Green Party candidate, and the “Democratic” Party is more than happy to abuse their power over the courts and legislature to keep Greens off the ballot whenever they can get away with it.

Senate Democrats on Thursday defeated an amendment sponsored by Sen. Jon Husted (R), Ohio’s former secretary of state, to require voters to show photo ID when casting ballots in person or voting by mail, despite previous statements by Senate Democratic Leader Chuck Schumer (N.Y.) that Democrats support photo ID requirements for elections.
The Senate voted 52-47 to defeat the amendment, which needed 60 votes to be adopted.
No Democrat voted for it.

The state case in 2019 was decided on the basis that the disclosure statute for presidential candidates violated the “open” presidential primary provision of the California Constitution, that says the SOS should put candidates generally advocated for throughout the country on the presidential primary ballot. That is, the constitution says put X, Y, Z, on the ballot, and the statute says to not put X on the ballot. The constitution wins.
The California Supreme Court case was “Patterson v. Padilla” (Alex Padilla was SOS at the time).
The federal district court decision was based on decisions such as ‘Gralike’ and ‘US Term Limits’, and that it did not apply to independent and write-in candidates, and would handicap qualified candidates in a nationwide election.
The district court case in California E.D. (Sacramento) was “Jerry Griffin et al v. Alex Padilla”. The federal case was later vacated by the 9th Circuit because the California Supreme Court decision made it moot.
In the Ware case, the SOS argued that the tax form disclosure was procedural as allowed under “Storer v. Brown”, where the SCOTUS determined that requiring independent congressional candidates to disaffiliate from a political party 12 months before an election did not violate the qualifications clause of the US Constitution (the candidates were running for Congress).
