Virginia wants the US Supreme Court to overturn an interpretation of the Virginia Constitution by the Supreme Court of Virginia.
The procedure to amend the Virginia Constitution is (1) Pass a proposed constitutional amendment; (2) Hold a general election; (3) Pass the constitutional amendment a second time; (4) Approved in referendum.
Presumably the reason for the intervening general election is so that candidates can campaign for or against the amendment (e.g, campaigning against Kansas/Nebraska act destroyed the Whig Party). In this case, the proposed constitutional amendment was approved on October 31, 2025; and the “intervening general election” was November 4, 2025; four days later. In Virginia, early voting begins 45 days prior to the election date. By the time the amendment was passed the first time almost 40% of voters had cast their vote.

There was also a curious procedure by the Virginia legislature. The Virginia Constitution limits regular sessions to 60 and 30 days, for even and odd year sessions, respectively. The legislature, by a 2/3 vote may extend the regular sessions by 30 days each.
Because Virginia elects its legislature in odd years, the first session is in even years. For this discussion, the election was in November 2023, and the first regular session began in January 2024. A special session was called in May 2024 to consider budget bills. The second regular session began in January 2025, and the special session was extended (i.e. the second regular session and the special session were concurrent). In October 2025, the special session was extended until January 2025, along with the addition of consideration of redistricting amendment. So while the two regular sessions were limited to at most 2 and 3 months, the special session lasted 20 months.
Since the Virginia Supreme Court decided the case on the issue of what an election day is, they said that they did not have to reach the issue of the never-ending special session.
Democrats in Virginia considered reducing the retirement age of judges from 73 to 54. In Virginia supreme court justices are elected by the legislature to 12-year terms, but they have to retired at 73, permitting election of a new judge.
If the retirement age was reduced to 54, all seven judges would be forced to retire, and the legislature could elected a new Supreme Court.
Two of the three oldest justices are black and voted in the minority on the 4-3 redistricting decision. The newest justice was elected just this year, and at 67 it would have been known that he could only serve six years or so.
The discussion of retiring the judges was apparently discussed in a “huddle” that included Hakeem Jeffries.
