Michigan Lawsuits Against Ban on Fusion

On May 21, the Michigan Common Sense Party and the Michigan Libertarian Party filed a lawsuit in state court against the state’s ban on fusion. The case is filed in the Court of Claims. Michigan Common Sense Party v Benson, 26-000106-MZ. The lawsuit depends on the state constitution. There are now cases in four states against the ban on two parties jointly nominating the same candidate. The others are Wisconsin, Kansas, and New Jersey.

On the same day, the same plaintiffs filed an almost identical case in the Circuit Court of Ingham County. It has the same name. Here is the filing.

  1. Fusion between libertarian dogma and common sense seems unlikely, but party names can be deceptive.

  2. Well, he certainly had not a lick of common sense. The Azerbaijani (.AZ) crAZy nAZi 666 spambot which was programmed by a troll demon to emulate a moron has negative infinity common sense.

  3. If someone wants to run as a Republican and the Libertarians or the US Taxpayers Party also wants to run that candidate, how is it teh state’s business to tell them they can’t? Most election laws are written to protect a duopoly and should be considered unconstitutional for that very reason.
